With the deepening of China’s reform,the social transformation and upgrading has entered the deep water stage,the main social contradictions have also begun to transform,and the social instability factors are complex and changeable.Under the new normal economy,harmonious labor relationship is an important factor to maintain social and economic development and order stability.At present,there are still some imperfections in China’s market economy and many contradictions in labor-capital relations.Although there are laws and regulations such as Labor Law and arbitration Law,the number of labor arbitration cases in China has increased in recent years.How to use labor arbitration to improve social relations management? This paper analyzes the theoretical and empirical research topics of labor arbitration to improve the management of social relations.From the current practice of labor arbitration,labor arbitration has a certain mediation role in improving labor relationship management,but in general,there are still many problems in China’s labor relationship management.First,the number of labor-management disputes remains high.Next,still existence capital does not pay labor remuneration to laborer according to the agreement according to labor laws and regulations,pay social insurance,remove or terminate labor contract relations.Thirdly,some workers dare not take legal approaches to safeguard their legitimate rights and interests due to many factors after their legitimate rights and interests are violated.Finally,China’s relevant laws and regulations are not enough to punish illegal enterprises,resulting in a low cost of illegal capital.Adopt literature analysis and statistical analysis,this paper based on the provincial panel data from 2011 to 2020,using SPSS software has carried on the correlation and regression analysis to data and information,through the empirical study results show that the success of unit of choose and employ persons in the labor arbitration because of the labor remuneration of laborers such disputes to the behavior of the labor arbitration has inhibitory effect,And laborer success,conciliation,arbitration cases due to the labor remuneration of laborers or remove and terminate the labor contract disputes to the behavior of the labor arbitration has a promoting effect,win rate of unit of choose and employ persons,laborer success,partial success,both sides,and the mediation and arbitration award for social insurance disputes had no significant correlation.In order to improve the management of social relations and play the role of labor arbitration,it is necessary to strengthen the publicity of labor arbitration and relevant laws,popularize arbitration laws and regulations and strengthen the legal consciousness of labor and capital.We should use subsidies to stabilize employment and reduce layoffs fundamentally.It is necessary to strengthen and promote the blacklist system of enterprise credit management,raise the illegal cost of enterprises and restrict the illegal behavior of enterprises.We should give full play to the function of out-of-case mediation to resolve labor dispute cases,so as to improve Industrial relations as soon as possible and save labor arbitration resources. |
