In recent years,e-commerce platforms have been developing more and more rapidly,and the development speed of Internet economy in various countries has also been improved to a certain extent,which is a manifestation of economic globalization and technologization.The development of Internet economy shows a very good trend.However,when there is a market,there will be competition.Fair market competition will promote the development of economy,while vicious market competition will bring great damage to various subjects.It is common for e-commerce platform to implement "choose one from two",which has aroused people’s widespread concern.Platform operators using incentive measures or punitive measures within the force platform operators "alternative",seriously violated the platform within the operator’s autonomy and consumer choice,as well as the competitive relationship with the platform caused certain effect,cause the fair market competition order,seriously hindered the healthy development of market economy.When the "alternative or alternative" behavior is regulated by the Anti-Monopoly Law of the People’s Republic of China(hereinafter referred to as the "Anti-Monopoly Law"),it is in accordance with the relevant provisions on restricted trading behavior in Chapter III abuse of Dominant Market Position.This paper mainly analyzes the application of "choose one from two" in the anti-monopoly Law from the following four parts.The first part is mainly to sort out the concept of "choose one" behavior of e-commerce platform,analyze the causes of this behavior,and analyze the competition effect of "choose one two" behavior,mainly from two perspectives of positive competition effect and negative competition effect.The second part is from the perspective of abuse of market dominance,analysis of relevant market,market dominance,unjustified reasons and exclusion and restriction of competition effect;The third part mainly analyzes the relevant situation of foreign regulations on platform monopoly behavior,mainly from the United States and the European Union analysis of identification standards and current status of regulations,in order to learn from foreign regulatory experience,to help better improve China’s regulations on e-commerce platform "two or one" behavior.The fourth part mainly analyzes the dilemma when applying the Anti-monopoly Law to regulate the "two or one" behavior.According to the difficulties,suggestions are put forward to better regulate the illegal behavior of "two or one",promote the development of economy and create a fair market competition environment.
