Research On Legal Risks Of Intellectual Property Securitizatioon

In the advancement of the national intellectual property strategy,intellectual property securitization is one of the important topics,but the legal risk is an important obstacle affecting the advancement of intellectual property securitization.Intellectual property securitization is a type of asset-backed securities(ABS).a new financing tool.The biggest problem in intellectual property securitization is valuation,that is,risks such as the value and ownership of intellectual property itself,other risks such as whether it is actually sold,legal risks of special-purpose institutions,and rating risks.In view of these risks,this paper proposes: to solve the legal risks of intellectual property itself by improving the intellectual property value evaluation system;to solve the legal problems faced in the real sales by defining the standard of real sales;to choose the form of trust and restrict the business activities of SPV etc.to solve the legal risk of special purpose institutions;to solve the credit risk through supervision and agreement.
