The Judicial Supervision Study Of The Local People’s Congress

In September 1954,the first session of the First National People’s Congress was held in Beijing.More than 1,200 deputies to the National People’s Congress elected by the universal suffrage adopted the Constitution of the People’s Republic of China at the Congress,which marked the formal establishment of the system of People’s Congresses.According to the design of this system,the People’s Congress is the organ of state power,which is elected by the people,and the people exercise state power through the People’s Congress.The government,the supervisory commission,the court,the procuratorateand other state organs are elected by the National People’s Congress and are responsible for and subject to the supervision of the National People’s Congress.Thus,in terms of the relationship and operation mechanism of various state organs,the People’s Congress is in the central position of the state institutional system and the state power system,which also determines that the People’s Congress bears an irreplaceable important responsibility for the supervision of public power in the national governance system.Judicature is the last line of defense for social fairness and justice.Judicial justice is an important guarantee for the realization of social rule of law.General Secretary Xi Jinping has made clear instructions that "Striving to make people feel fair and just in every judicial case".As a local organ of state power,the local People’s Congress should supervise the judiciary in accordance with the Constitution and laws,which is exactly what it should do.In the face of new tasks and new situations,how local People’s Congresses can better perform their duties and promote social fairness and justiceand meet the growing needs of the people for a better life has gradually attracted the attention of the society,and the voice for further strengthening the judicial supervision of the People’s Congresses has also been strong.Based on the research on the current situation of judicial supervision practice carried out by the People’s Congress of H Province,this paper hopes to explore the common problems and deficiencies existing in the exercise of judicial supervision by the local People’s Congress and to analyze the restrictive factors affecting the exertion of functions,and sort out some countermeasures and suggestions to improve the judicial supervision level of the local People’s Congress based on the principle of finding,analyzing and solving problems,expecting to be beneficial to the local People’s Congresses for better performing their functions of judicial supervision and to provide help to stick to the last line of defense of fairness and justice.
