The Study On The Changes Of How Rural Justice Serving Social Governance

Focus on people’s court’s judicial activity analysis,this paper points out that rural justice focus on the resolving of disputes rather than enforcement of law strictly,and rural justice means to realize social governance thought the way of solving disputes through judicial;the process of rural justice is integrated into the process of social governance.In the new rural society,with the changes of the countryside and the people’s court itself,the characteristics of the rural justice in the new rural society have also changed.It pays more attention to the settlement of cases through law,focusing on the establishment of rules.Under this change,the new rural justice also changed the way of serving social governance,by strictly applying legal procedures to distinguish responsibilities and guiding parties to abide by legal rules through the results of legal analysis.The fundamental factor behind the changes lie in the combination of the transformation of The rule of law in China and the principle of justice for the people.In order to realize the function of serving social governance,the people’s court cannot do without its judicial activities.Therefore,the integration between rural justice and serving social governance should be realized.The people’s court itself has also made efforts.On this basis,the two principles of"modernization"(The rule of law)and "convenience"(Justice for the people)should be integrated to bridge the tension between rural justice and social governance by promoting the governance of litigation sources,realizing the discrimination of cases and integrating social forces.This paper consists of four chapters:Chapter one:Through the case analysis we could know that rural justice has the characteristics such as squaring,closing to the masses,relying on the government,then show that rural justice means to realize social governance thought the way of solving disputes through judicial;the process of rural justice is integrated into the process of social governance.And further explaining the shortcomings of this approach.Chapter two:Discussing the changes of the local society and the people’s court,explains that the foundation of the local society is disintegrating,and the acquaintance society,mediation authority and behavior rules are all changing.At the same time,people’s courts are also changing,the number of court personnel,cases and scope are obviously different from before.Chapter three:Through the comparison of cases,we could see that the characteristics of new rural justice have turned to legalization,theater and gradually separated from the government,and its way of serving social governance has also changed,that is,to define responsibilities through strictly applying of legal procedures,to establish legal rules through the results of legal analysis;Then it shows that the new rural justice is the inevitable requirement of modern rule of law,but its way of serving social governance also has deficiencies.Chapter four:The analysis shows that the fundamental factor behind the changes of the transformation of rural judicature lies in the combination of the transformation of the rule of law in China and the principle of justice for the people,and points out that the efforts of the people’s court have little significance in solving the insufficiency of judicature and social governance.Rural justice should follow the principle of modernization and convenience,and there are several ideas of realizing the integration of rural judicature and service society governance.
