Research On Intellectual Property Problems Faced By Technolopy-based SEMs And Countermeasures

We are in the era of rapid development of science and technology,technological innovation is the beacon to guide enterprises to move forward,intellectual property rights as the result of revolution,has become a significant resource for enterprise competition.Technology-based SMEs are the most vitality of innovation in China,which not only alleviates employment pressure and expands tax sources for the country,but also the main force for technological innovation and the use of intellectual property creation.As of February 2022,there are 603867 science and technology SMEs registered with the Ministry of Science and Technology,and there are more coastal developed provinces such as Jiangsu and Guangdong.The "14th Five-Year Plan" National Plan for the Protection and Application of Intellectual Property Rights proposes to stimulate the vitality of social innovation,comprehensively improve the level of enterprises in the creation,application,protection,management and service of intellectual property rights,and technology-based SMEs,as the irreplaceable subjects in technological development and breakthroughs,are the objects of key support and development of China’s economy.Studying the current situation and problems faced by technology-based SMEs in the creation,application,protection,management and service of intellectual property rights will help technology-based SMEs to better operate intellectual property rights and enhance their core strength on the one hand;on the other hand,to identify shortcomings,provide reference for national policy support directions,and accurately implement policies.Through research,the author has found that in the creation of intellectual property rights,the investment in innovative resources is insufficient,and the guidance direction of the intellectual property creation mechanism is not scientific;in the use of intellectual property rights,it is difficult to transform scientific and technological achievements and pledge financing;in the protection of intellectual property rights,the risk of infringement is high and it is extremely barrier to protect rights;in the management of intellectual property rights,the management institutions and systems are not perfect and the degree of refined management is not enough;in terms of intellectual property services,service institutions face problems such as vicious market competition and insufficient standardization of services.If we face these intellectual property problems for a long time and do not seek a way out,technology-based SMEs will only fall into the bottleneck of development and eventually lose in competition.How to enhance the level of protection of science and technology SMEs in the whole chain of intellectual property rights has become an urgent problem for China’s science and technology SMEs to solve.To this end,from the perspective of the analysis of intellectual property-related laws,policies,statistics and cases,this paper analyzes the intellectual property problems encountered by technology-based SMEs,carefully takes stock of China’s intellectual property laws,regulations and policies,finds out the provisions that relevant laws and policies cannot achieve practical results,and puts forward suggestions and improvement measures for reference from the aspects of the protection of the whole chain of intellectual property rights of technology-based SMEs,the improvement of laws and regulations related to the transformation of scientific and technological achievements,and the optimization of the business environment of enterprises.
