| With the continuous advancement of legal education reform,moot court has now become one of the important training activities for legal affairs majors in secondary vocational schools.The moot court makes up for the deficiency of traditional legal education that emphasizes theory and ignores practice with its practicality of teaching activities,systematic teaching process,diversity of teaching effects and always being student-centered.The moot court has the teaching functions of cultivating students’ procedural operation ability,ability to analyze cases and use evidence,ability to write judicial documents,court language expression and flexibility.At present,the vast majority of colleges and universities offering law majors have taken mooting as a compulsory professional training course and incorporated it into the talent training program for law majors,but the secondary vocational schools offering legal affairs majors have not yet carried out curriculum reform..In recent years,the role of secondary vocational education in my country has become increasingly prominent.Therefore,it is an urgent problem to carry out mooting in secondary vocational schools in an orderly and efficient manner,and to incorporate mooting into the training plan of secondary vocational legal affairs professionals.The first part of this paper summarizes the research status of moot court at home and abroad and introduces the development status of moot court in secondary vocational schools in my country,so as to learn from excellent experience and guide the teaching practice of secondary vocational schools.The second is the research methods and innovations of the paper,which play a role in the layout of the opening chapter.The second part is an overview of the moot court,from the three aspects of the concept,characteristics and theoretical basis of the moot court,expounds the theoretical basis and value of the moot court.The third part discusses the teaching value of the moot court for the legal affairs majors in secondary vocational schools,and concludes that the legal affairs majors in secondary vocational schools have talent training and focus on practical ability,employment positions are biased towards the grassroots,professional courses are single,and secondary vocational students are in the stage of physical and mental development.Compared with other practical teaching activities,the moot court has the characteristics of clear goals,practice orientation,flexible form,easy to carry out,immersive,active participation,advancing with the times,and grasping the overall situation,which is more in line with Chinese Development requirements of vocational school students.The fourth part is the investigation and research on the moot court teaching activities carried out by the legal affairs major in secondary vocational schools.Through the research methods of questionnaire survey and case interview,through data analysis and the sorting of the interview content,it is found that there are defects in the standardization of the moot court curriculum,and the investment of class hours There are serious deficiencies,insufficient pre-trial preparations,improper selection of cases,and the phenomenon of emphasizing "performance" over "practice".The fifth part proposes the optimization path and specific implementation of moot court for legal affairs major in secondary vocational schools.It should standardize curriculum setting,increase investment in curriculum development,increase practical class hours,expand practice channels,attach importance to pre-trial work,optimize case selection,and promote simulation.The court has been optimized in terms of changing from "active" to "teaching" and enriching moot court curriculum resources to enhance teaching effectiveness.And on the basis of summarizing the experience and conclusions,it sorts out the main points of moot court teaching for legal affairs majors in secondary vocational schools,and discusses practical skills teaching,case selection,assignment of groups and roles,pre-trial preparation,trial and summary evaluation.Perform nuanced profiling and design.In order to reduce the possibility of repeated occurrence,the situations that frequently occur and need attention in specific teaching practice are listed separately.The last part is the conclusion.Under the background of researching the new trend of legal education development,this paper draws on the excellent experience of law majors in domestic colleges and universities in order to improve and perfect the deficiencies in the teaching of moot court training in secondary vocational schools.To enable students to effectively increase legal knowledge,improve legal skills,and adapt to the requirements of socialism with Chinese characteristics in the new era for legal talents. |
