| As a special part of the government’s financial revenue,the civil penalty income,which revenue and expenditure management of the confiscation revenue is managed by the government according to the “ revenue and expenditure two lines “.The main meaning of administrative law enforcement is to correct and eliminate illegal behaviors and prevent illegal activities.As a by-product of law enforcement,the civil penalty income,use and supervision of confiscation income are widely concerned by the society because it involves the interests of the government,departments and the public.Since the whole revenue and expenditure process involves many law enforcement departments,the implementation of policies in the use of the budget for the return of confiscated income and the supervision link is not the same.Since the beginning of the expenditure link,the implementation effect of relevant policies will react to the collection process,forming the chaos of law enforcement such as“ profit-seeking law enforcement “,thus damaging the interests of the public.Starting from the “fuzzy-conflict“ model,this paper makes a detailed analysis of several implementation cases of budget allowance policies of confiscation income in different places and law enforcement departments,and discusses the negative externalities of policy implementation.Analysis that reflect the subsidy from Civil penalty shall allot the policy implementation effect of the key factors in the process of executive main body(e.g.,local resources,the object,interest,policy,target between,examining relations,etc.)and may cause the bad social influence,such as law enforcement administrative inaction,frequent profit-seeking enforcement chaos,the ideal of the rule of law order destruction,government credibility decline,etc.).This shows the root of a series of chain problems in the revenue and expenditure of confiscation intuitively,and provides empirical cases and decision-making reference for improving the efficiency of the use of local government financial funds by deeply digging out the causes of disorderly law enforcement.By combining other confiscated income compare the use of policy experience,both at home and abroad for the local government confiscated contradictions conflict of reality and long-term income return policy Suggestions targeted solutions and Suggestions for improvement of the incomes collected from fines shall return the policy,such as confiscated subsidy policy legal basis,clear the incomes collected from fines shall use scope,perfect the supporting policies,Establish and improve the assessment system information disclosure and oversight and accountability mechanism. |
