Problems And Path Choice Of The Comprehensive Administrative Law Enforcement At Grass-Roots Level

Since the State Council approved Xuanwu District,Beijing,to take the lead in implementing the pilot reform of relatively centralized power of administrative punishment in the field of urban management in 1997,the pilot reform of the comprehensive law enforcement system in urban management has been carried out in large and medium-sized cities across China.By 2022,Shandong Province has come to the seventh year in promoting the reform of the law enforcement system for urban management.The reform of the law enforcement system has brought positive changes to the Comprehensive administrative law enforcement at the grass-roots level and effectively promoted social advancement in the economy,culture,and other aspects.However,it should also be recognized that the current comprehensive law enforcement reform is incomplete in various regions,with more and more issues arising.The grass-roots level comprehensive administrative law enforcement involves a wide range of fields and multiple and complex authorities.There are various objects of law enforcement,and the requirements also vary for different fields.Therefore,in law enforcement practice,it should be cautious in the choice of methods,governance means,and so forth,which should be in line with the requirements of comprehensive law enforcement at the grass-roots level and the actual situation of the region,so as to achieve legitimate administration,proper procedures,unification of rights and responsibilities,high efficiency and convenience for the people.With Comprehensive Law-enforcing Bureau of J County,R City,as the research object,the semi-structured interview is adopted in this paper to obtain the real data and information,encode and analyze them through the theme analysis method,and deeply interpret the problems in and the reasons of the current community-level comprehensive administrative law enforcement.The main problems that have been found include passive or selective law enforcement,failure of flexibility in law enforcement,unclear rights and responsibilities among administrative law enforcement departments,and so on.Through further analysis and in combination with the theories of Street-level bureaucracy,embedded law enforcement,and other theories,the optimization suggestions have been put forward for the comprehensive administrative law enforcement of J County from the aspects of law enforcement norms,construction of law enforcement team,selection of law enforcement methods,mechanism of cross-departmental coordination,etc.Proposed measures include regulating selective law enforcement,strengthening the construction of law enforcement teams,exploring and improving technical governance means,adopting the "rigid and flexible" approach in law enforcement,designing the mechanism of cross-departmental coordination,enhancing the agreement of behaviors between the law enforcement subjects and objects,etc.Thus,providing relevant ideas for effective and scientific comprehensive administrative law enforcement in J County.Moreover,this research is also expected to provide a reference for comprehensive administrative law enforcement at the grass-roots level in other areas.
