On The Research Of Special Signs Protection

As the comprehensive national strength of China constantly improves,the influence of our country is gradually growing in the world.There are more international cultural,sports and scientific and technological activities being held in China.The issue of how to effectively protect various signs related to the activities has begun to attract the attention of people.It is often the huge public financial investment behind the special signs,so the huge social influence is also brought.Countless businesses are attracted and would like to take the opportunity to make profits,which leads to the generation of infringement act.The endless emergence of infringement act from the infringement case of Olympic logo in early 2000 to the repeated infringement of the "Bing Dwen Dwen" in the 2022 Winter Olympic Games in Beijing reflected the deep-seated reason behind it,that is,the existing special sign protection system has failed to fully satisfy the needs of reality.When it comes to the research on the legal protection of special signs in China,it is still in the initial stage,which has not formed the systematic theories and opinions in terms of both theoretical research and legislative research.In this thesis,the research status of the protection of special signs at home and abroad is comprehensively analyzed,the nature of the right of special signs is clarified,a detailed analysis on its private right attribute and intellectual property attribute is carried out respectively.Through the above analysis,the existing protection system of special signs is summarized,and the four problems are found as follows,such as the low legal level of special signs protection;the narrow protection scope of special signs;the short protection period of special signs;and the loopholes in the protection of special signs in the existing trademark system.The corresponding solutions are proposed in this thesis for the above problems,such as perfecting the legislative protection system of special signs in China,expanding the scope and types of special signs protection,diversifying the protection period of special signs,and increasing the avoidance system of special signs in the process of trademark registration.
