Under The Background Of "Reform Of Government Functions" The Research On Legal Regulation Of Sport Social Service Organizations

The sports social service organization is a basic organization form of our country’s sports social organization.It has a unique role in the field of public service.The number and scale of its development have occupied a considerable proportion in the field of sports.In the development process of sports social service organizations,the law has played a normative and guiding role.At present,there are still many problems in the legal environment of sports social service organizations,which deserve our attention and solve them through analysis and demonstration.The research is based on relevant legal documents,taking the legal regulations of sports social service organizations as the research object,using documentary data method,text analysis method,logical analysis method,and comparative research method.The research analyzes and discusses the course of legal regulation of sports social service organizations,the provisions of current laws,the results achieved,the existing problems and the legal regulation strategies that should be adopted.The research conclusions are as follows:(1)Sports social service organizations are a relatively special type of sports social organizations in our country,carrying out business activities in their daily operations,and their operation mode is similar to that of enterprise operations.So it is necessary for the national legislature and administrative departments to adopt corresponding legal means to guide and cultivate the development of sports social service organizations.(2)The subject of legal regulation of sports social service organizations is the national legislature and the administrative department;the object is the sports social service organization in the activity;the main basis and means are various legal documents.The current legal regulation of sports social service organizations is mainly economic regulation in terms of purpose,and direct regulation in terms of function.(3)The legal regulation process of sports social service organizations can be divided into three stages:the start period(1979-1995),the development period(19952016),and the innovative period(2016 to present).Marked by the review and approval of the "13th Five-Year Plan" in 2016,the promulgation of the Charity Law and the issuance of the "Central Office No.46 Document",the development of social service organizations has entered a new stage.(4)The results of the current legal regulation of sports social service organizations are mainly manifested in:giving the organization a formal legal status,establishing a relatively sound external management system and a relatively complete internal governance structure.But at the same time,the legal environment of sports social service organizations still has problems such as backward legislative concepts,biased organizational positioning,difficulty in coordination between legislative departments,insufficient tax and fee concessions,and unclear government purchase regulations.(5)In the context of "reform of government functions",the main tasks facing social organization management are:relaxation of registration,innovation of supervision,and fostering development.The legal regulation strategies of sports social service organizations mainly include:exploring unified registration,unifying legal personality,relaxing branches;advancing joint supervision,implementing annual reports;adjusting tax and fee concessions,implementing market pricing,and optimizing the government procurement and other measures.
