Research On The Value Of Harmony Of A Community Of Shared Future For Mankind From The Perspective Of International Law

In the context of global governance,China has put forward the concept of a community of shared future for mankind.This kind of concept is based on the thought on international rule of law previously advocated by China in keeping with the trend of the times,which is built on the basis of common values and is the innovative achievement of China’s thought on international rule of law in the new period.The value of harmony is the complement of values of international law and the pursuit of a better state of the whole world based on the value of peace.Although the concept of a community of shared future for mankind does not directly indicate the existence of the value of harmony,it contains many connotations of the value of harmony.Taking the value of harmony as the core of the concept can better guide the construction of a community of shared future for mankind and turn the concept into practice.At present,the research on the value of harmony and the construction path of a community of shared future for mankind are not in-depth.In this regard,it is necessary to analyze the multilevel connotation of the value of harmony,and further study the interactive relationship between the value of harmony and the construction of a community of shared future for mankind,so as to construct a community of shared future for mankind more efficiently.Based on the above knowledge,this paper carries out research in the light of the logical thinking of the introduction,the proposed process and theoretical basis of the concept of a community of shared future for mankind,the role of the value of harmony in the construction of a community of shared future for mankind,the influence of the construction of a community of shared future for mankind on the value of harmony,constructing a community of shared future for mankind in the interaction with the value of harmony.The first chapter briefly elaborates the background and development process of the concept of a community of shared future for mankind,and also analyzes the theoretical basis of the concept,so as to summarize the significance of the concept in the field of international law and lay the foundation for the subsequent research.The second chapter analyzes the role of the value of harmony in building a community of shared future for mankind.Firstly,this chapter combs the definition and content of values of international law claimed by scholars at home and abroad,and clarifies the importance of the value of harmony as one of values of international law.Secondly,the chapter focuses on the analysis of the meaning of the value of harmony: inclusiveness embodies the pursuit of the value of harmony for a common belief,and it also pays more attention to the protection of the diversity of world civilization;obligations erga omnes and Jus Cogens safeguard the common interests of the community;a win-win situation exemplifies the role of the value of harmony in promoting international cooperation,in order to achieve the common prosperity of the community.The third chapter analyzes the influence of building a community of shared future for mankind on the value of harmony.China ’s practices of building a community of shared future for mankind clarify the true meaning of the value of harmony;the Five Principles of Peaceful Coexistence provide successful experience for enhancing the international influence of the value of harmony;the development of international environmental cooperation and the principle of sustainable development promote the realization of the value of harmony.Aiming at the interactive relationship analyzed above,The Fourth Chapter draws the idea of constructing a community of shared future for mankind in the interaction with the value of harmony.In this construction process,countries and international organizations play different roles,and the international legal system should also be developed and improved accordingly.The value of harmony and the concept of community of a community of shared future for mankind demand the way of treaty making of international law,which is reflected in the universal members of treaty making,the package negotiating ways and the consensus decisionmaking.Their requirements on the proceedings of the international tribunals are reflected in Amicus Curiae,provisional measures and fact-finding powers.The fifth chapter summarizes the contents of four chapters above,and makes a simple evaluation of the construction of a community of shared future for mankind.
