Commercial habits are habits or practices that people have formed in various business activities for a long time.Suzhou is a treaty port that opened earlier in The nineteenth century in China,with a prosperous economy,many commercial disputes,and rich commercial habits.At the end of the Qing Dynasty,the commercial customs in Suzhou played an important role in protecting commercial activities,mediating commercial disputes,maintaining economic order and promoting commercial legislation,which is of great reference significance for the current optimization of commercial habits in China.During the late Qing Dynasty and the Republic of China,the invasion of great powers promoted social transformation,the long-standing anti-business policy gradually declined,the agricultural economy and the capitalist economy blended with each other,and the business thinking changed,which laid the foundation for the formation of commercial habits in the Suzhou area of the Late Qing Dynasty.In modern times,there are many forms of commercial customs in Suzhou,and the charter of the Chamber of Commerce,the regulations of the same industry,and commercial taboos are the main manifestations of commercial customs.Commercial habits of money and debt,commercial habits of bills,commercial habits of partnership and trademarks are the main types of commercial habits.However,due to the influence of the current situation and politics,some new commercial habits have also emerged,and the content of commercial habits has become increasingly rich.At the end of the Qing Dynasty,the Suzhou region of the Republic of China was widely used,and the central government twice carried out large-scale civil and commercial custom investigation campaigns to collect commercial customs and carry out commercial legislation;judicial organs used commercial customs to adjudicate cases;and non-governmental organizations mediated commercial disputes based on commercial customs.Taking the commercial customs of the Suzhou area of the Late Qing Dynasty and the Republic of China as a reference,several aspects,such as improving the legislative model of commercial customs,clarifying the identification criteria for the judicial application of commercial customs,and establishing the status of the basis for mediation of commercial customs,should be the focus of research and application of commercial customs in the current legislative judicial practice.By sorting out and analyzing the content and theoretical basis of commercial habits in Suzhou during the late Qing Dynasty and the Republic of China,we can explore their significance for the current formulation of commercial laws,judicial reforms,and the improvement of non-litigation dispute resolution mechanisms.In short,studying the commercial habits of Suzhou in the late Qing Dynasty and the Republic of China period will not only help us to explore the great contributions of commercial habits in resolving commercial disputes,stabilizing economic order,and promoting commercial legislation,but also provide enlightenment for the good use of commercial habits in today’s legislation,judicial practice and dispute resolution.By sorting out the specific content of commercial habits in the Suzhou area of the late Qing Dynasty and the Republic of China,and analyzing their influence of the times,it is expected to provide historical experience for the development and improvement of China’s commercial legislation,judiciary and commercial mediation.
