| The Visigoths were an East Germanic group that,as they came into contact with the Roman Empire,began to move from custom to statute in law.In 681 the Visigothic Code was published,which contained a number of laws relating to women.These laws embodied the rights Visigoth women could exercise and the duties they had to fulfill in their lives.This paper mainly explores the provisions of women’s rights in the code,so as to further investigate women’s roles and property rights,in order to maximize the recovery of women’s survival scenes in the society at that time.At home and abroad,because women are in a marginal state in society,there are few special studies on women’s rights in the Visigothic Code.Most foreign scholars put Visigoth women in the general investigation of Germanic women,but did not do systematic research on Visigoth women.The full text consists of three parts: introduction,text and conclusion.Among them,the text is divided into three chapters.The first chapter describes the legal development of the Visigoth kingdom,which is divided into two sections.The first section explains the social development course of Visigoths from tribe to kingdom establishment,which is the process of the integration of Visigoths and Romans,and also the social background of the birth of the Visigoth Code.The second section describes the process of the Visigoth Kings compiling laws,which lays the foundation for exploring the attributes of the Visigoth Code.In addition,the Visigoth Code classifies the provisions concerning women,with specific reference to such aspects as female marriage,female injury and inheritance.The second chapter elaborates the role of Visigoth women and women’s property rights according to the Marriage Law in Volume 3 of the Visigoth Code and other legal provisions,which is divided into three sections.The first section firstly explores the ownership of Visigoth women’s discourse power in marriage from the legal marriage stipulated in the Visigoth Code.The second section explores the legal punishment of Visigoth women by interpreting the relevant legal provisions of personal injury to women.The third section mainly expounds women’s property rights in the code.In this part,women’s property acquisition is divided into two ways: female property transfer in marriage and female inheritance,and analyzes Visigoth women’s ownership,disposal,usufruct and other rights of these properties.The third chapter summarizes and generalizes the status of Visigoth women,which is divided into two sections.The first section analyzes the role and property rights of Visigoth women and summarizes the status of women in the family.The second section is to define the status of women in society through the rights of women at all levels of Visigoth society and women’s participation in public life.In conclusion,this paper aims to explore the personal rights and property rights of Visigoth women through the static analysis of the female related legal provisions of the Visigoth Code.At the same time,it puts Visigoth women in the historical context of late ancient times,and dynamically examines the role and power changes of Visigoth women in family and society,so as to make a realistic position for the historical status of Visigoth women. |
