At present,it is often assumed that parents have the right to raise their children, mainly for reasons such as biological and a lot of care, which ignores the moral consideration of children’s equality. In society, this one-sided and inadequate view of the moral basis of parental rights inevitably becomes the fuse of parent-child conflicts. In explaining the moral basis of parental rights,parent-centered and child-centered theories give their respective theoretical schemes. The former, based on biological correlation, understands parental authority as a right with ownership significance; The latter regards the protection of children’s rights and interests as the threshold for parents to enjoy parental authority, and interprets parental rights in terms of limited management rights. In this debate,a third solution,dual-interest theory, focuses on the role of the value of parent-child intimacy in explaining the basis of parental rights. On the one hand, intimacy requires the restriction of parental rights through the basic interests of the child;Intimate relationships,on the other hand, are legitimately concerned with the importance of parents perfecting themselves through parenting. It can be seen that the intimate relationship argument based on the dual-interest theory can reveal the characteristics of intimate relationships that tolerate parent-child differences and promote children’s self-construction by analyzing the connotation of intimate relationship. This form of argument is the most reasonable and promising in explaining the basis of parental rights. |
