Research On The Basic Administrative Law Enforcement Problem Of Qingyuan Forestry Bureau Under The Background Of Institutional Reform

With the continuous improvement of the reform and theory of forestry administrative law enforcement,the competent forestry authorities are the main body of forest ecological resources protection in China,and their administrative law enforcement behavior and law enforcement effect directly affect the efficiency of ecological space governance in China.This paper takes the grass-roots administrative law enforcement of Qingyuan Forestry Bureau after the transfer of forest public security personnel,Analyze the problems in the process of grassroots administrative law enforcement by means of case study,questionnaire survey and interview with forestry related personnel,The problem is focused on three areas: First,The deterrent power during the transition period is relatively impaired,The performance is: the loss of law enforcement forces,the vacuum of law enforcement links with new functions,The loss of criminal filing qualification and the deterrence of the first time evidence collection control is not enough;second,Grassroots administrative law enforcement procedures are not standardized,The performance is: the current law enforcement system is difficult to undertake the heavy and urgent law enforcement tasks,Lack of awareness of grassroots law enforcement personnel on the scope of law enforcement authority;third,The efficiency of administrative law enforcement work needs to be improved,The performance is: the definition and transfer of administrative and criminal cases is not smooth,The jurisdiction and division of labor of forest-related work at the county and township levels are still not coordinated.The reasons are as follows: first,the construction of grassroots administrative law enforcement function lags behind the reform practice,the grassroots administrative law enforcement team and the coordination process of forestry administrative law enforcement needs to be improved;second,the construction of law enforcement team can not meet the actual needs,the law enforcement needs of township comprehensive law enforcement team,the law enforcement qualification cleaning and education training of law enforcement personnel need to be promoted;third,the coordination mechanism of administrative law enforcement has not been perfect,the coordination mechanism is not perfect to restrict the execution connection,and the jurisdiction mechanism is unreasonable to weaken grassroots law enforcement.Subsequently,the article combines the experience of forestry administrative law enforcement in the United States and the European Union,Fujian Nanping and Chongqing,and puts forward three suggestions for improvement,namely,to accelerate the reconstruction of the authority of forestry administrative law enforcement,rebuild and optimize the forestry administrative law enforcement team,and optimize the construction of supporting mechanism of forestry administrative law enforcement.To strengthen the administrative law enforcement after the transfer of forest public security,Focusing on the effectiveness of grassroots administrative law enforcement,the ability of administrative law enforcement and procedures,and the cooperation and cooperation of administrative law enforcement,Theoretical discussion on the basic forestry administrative law enforcement after the transfer of forest public security,Clarify the basic concept of forestry administrative law enforcement,Different from previous studies on urban governance,To study the core elements,authority structure and structural issues of administrative law enforcement in the field of forestry management,Detailed the domestic administrative law enforcement research,Enrich the theoretical content and analysis structure of forestry administrative law enforcement,Provide reference for the scientific development of forestry grass-roots administrative law enforcement work in the future;Provide corresponding analysis reference for the modernization of forestry in the new era,It is of certain significance to promote the comprehensive and balanced development of forestry legislation,law popularization and law-abiding;At the same time,it can also provide reference samples for other cities to optimize the forestry administrative law enforcement work.
