| At present,local legislation has been widely carried out on green building in China.For example,the standing committees of provincial people’s congresses in more than 10 provinces,municipalities and autonomous regions such as Hunan and Jiangsu have passed and issued regulations on green building development.However,the national unified legislation of green building has not yet been completed,the legal standard system has not yet been formed,and the supporting policies and measures are scattered and chaotic.Hanging balance and know the flat,set the rules and know the circle.The Chinese government has solemnly promised to the world to achieve carbon neutrality by 2030 and 2060 respectively,so it is a urgent task to promote energy conservation and emission reduction in all areas of economic construction.It is estimated that the construction industry accounts for 30 percent of the total carbon emissions.Therefore,based on the formulated relevant laws and regulations,evaluation standards and industry norms,China’s green building legislation urgently needs to stand on a new commanding point.Abandon the narrow sense concept of green building in the past,and adopt the broad concept of green building with an open and developing attitude.Under the framework of green building,building energy conservation,renewable energy,green construction,green building materials and other contents will be systematic,and the basic,universal and fundamental problems of green building will be studied with new vision and new thinking.In accordance with the development trend of contemporary architecture,implementing the concept of green development,starting from the national policy orientation of promoting the development of green building and the legislative status of relevant laws and regulations,we conduct an in-depth interpretation of the current green building laws and norms,and find that there are many problems in the systematic construction.First of all,the narrow sense of green building concept has been unable to meet the needs of green building legislation to systematic development,and the lack of high-level green building specialized laws leads to weak regulation.Secondly,the differentiated development of various places adds difficulty to the unified legislation.The existing green building regulations of various provinces and cities are mostly based on cities or cities,and only the general contents can be mentioned in rural areas.Thirdly,the specialized planning of green building does not effectively connect it with the overall planning,resulting in a disconnect phenomenon.Finally,the lack of close connection between legal norms and policy causes policy constraints;lack of indispensable supporting standard system based on the construction field.In order to relieve the difficulties in the systematic process of green building legislation,it is necessary to take the concept of green development determined in the Constitution,take into account the national policy goal of carbon peak and carbon neutrality,combine the legal concept of building energy conservation and the concept of comfortable and livable life,and jointly help the development of green building.The definition of green building should not be limited to the current definition,but should adapt the related construction areas to the characteristics of green building.When carrying out legislative level design for green buildings,with the purpose of formulating a basic law with leadership and high effectiveness,integrate and modify relevant laws to avoid duplication and conflict of provisions,and coordinate with local legislation.So both high position leadership,but also according to local conditions of the landing means.Because the specification system of green building is not sound,the specification content is slightly abstract,most of which are advocating norms,and the coercive force is obviously insufficient,so in the establishment of legal norms,attention should be paid to the combination of mandatory norms and incentive norms,so as to achieve the effect of rigid and soft,and provide definite guidance for practice.At the same time,make clear the legal responsibility of each participant in the construction process in order to ensure the return of responsibility.Moreover,according to the actual needs of local and industrial green building development,supporting policies and measures should be introduced,and green building related systems will be improved,and the promotion of standard normalization,new technologies,new processes and new materials will be incorporated into the policies,so as to form a complete green building industry chain and boost the realization of the scale of green building. |
