Research On The Carbon Inclusive Legal System Of Green Commuting Under The Background Of "Carbon Peaking And Carbon Neutrality"

In order to jointly tackle the global environmental crisis,countries around the world have put forward the goals of "carbon peaking" and "carbon neutrality" in line with their national conditions.This is our solemn commitment to tackle global climate change and reduce our carbon emissions based on the requirements of the community of shared future for mankind and the new development concept.It is also the basic principle to guide our innovation in all walks of life.As one of the important industries with a large carbon emission base,it is urgent to maintain low-carbon development.It is not only necessary to strictly control the transportation industry through technological innovation and other means at the production end,but also to give full play to the broad emission reduction potential at the consumption end.Green commuting carbon inclusive,as a positive incentive mechanism,is starting from the consumption end,promoting the participation of the whole people,cultivating the commuting concept of low carbon saving and green environmental protection,changing the commuting mode,forcing the transformation and upgrading of the production end,so as to improve the level of low carbon development of the whole society and promote the process of ecological civilization construction.The long-term development of green commuting carbon inclusive cannot be separated from the constraints and guarantees of the legal system.This paper focuses on the carbon inclusive legal system of green commuting,which is divided into four parts.Part One: Explains the basic concepts related to "carbon peaking and carbon neutrality" and carbon inclusive benefits for green commuting,Outlines the relationship between carbon inclusive benefits and carbon trading market,and analyzes the theoretical basis involved in the construction of the legal system of carbon inclusive benefits for green commuting.The second part: With the help of historical analysis method,the present situation of China’s green commuting carbon inclusive legal system is explored,and the four main obstacles of China’s green commuting carbon inclusive legal system are sorted out: imperfect legislation,imperfect standards,lax supervision and inadequate public participation guarantee legal system is not detailed,and the causes of the main existing problems are analyzed in depth.The third part: Using the comparative analysis method,referring to the relevant practices of green commuting in and outside the domain,summarizing the excellent experience,taking this as the basis for extension and expansion,and obtaining the experience on the construction of China’s green commuting carbon inclusive legal system in improving the legislative system,taking multiple legal incentive measures,unified accounting standards,open and transparent information disclosure of the platform and other aspects.The fourth part: Using normative analysis method,according to the existing problems of China’s green commuting carbon inclusive legal system,put forward targeted suggestions on improving legislation,improving standards,optimizing supervision and refining the legal system of public participation guarantee.By studying the specific performance of China’s green commuting carbon inclusive legislation system in four aspects,including legislation,standards,supervision and public participation,this paper points out the detailed direction for carbon inclusive legislation.At the same time,in order to provide thoughts for the construction,development and improvement of the legal system of carbon inclusive commuting,promote the formation of the whole people participation and benefit of carbon inclusive recycling "ecological circle",for our country to realize the "double carbon" goal as soon as possible.
