| With the development of production socialization,the trend of regional economic integration is becoming more and more significant.At the same time,because the environment has the characteristics of public resources,externalities and spatial extension,the environmental problems increasingly show the trend of integration.However,the integrity of the environment is often divided between different administrative regions,and the "independent" environmental protection policy is not applicable to the environmental problems of trans-regional pollution,so it is necessary to establish an effective legislative mechanism of environmental coordination across regions.Promote regional coordinated development is the strategic basis of building domestic big cycle,therefore as early as 2018,the State Council issued "about the establishment of more effective regional coordination development mechanism of opinions",points out that the new era of national development strategy is to implement the strategy of regional coordinated development,improve the regional function orientation,enhance the integrity and synergy between regional development.In addition,the party’s 20 th annual report in 2022 also pointed out that the coordinated regional development should be promoted,and the regional coordinated development strategy should be thoroughly implemented.In this context,the study on ecological environment collaborative legislation in Guanzhong Plain urban agglomeration can not only provide institutional support for regional collaborative legislation,but also prove that inter-regional ecological environment governance is the actual need of regional collaborative legislation.Collaborative urban development has now become an important issue in promoting China’s national economic development and a key factor in influencing the standard of living of society.Guanzhong plain urban agglomeration is located in the northwest inland of China,is an important fulcrum of the asia-europe land bridge,ecological environment is fragile,regional water resources,air quality are facing serious problems,the overall ecological situation of the guanzhong plain urban agglomeration is not optimistic,based on the characteristics of environmental resources public,complexity,liquidity,need to break the city administrative boundaries through collaborative legislation.Although Article 10 and Article 49 of the Organic Law of the Local People’s Congresses and Local People’s Governments as newly amended in 2022 and the Legislation Law of the People’s Republic of China as amended in 2023,Local people’s congresses and their standing committees were given corresponding regional coordinated legislative power,But because these regulations are too general,Instead of refining the coordination of regional collaborative legislative power between local people’s congresses and their standing committees,Moreover,the legislative model of the NPC is complex and long-cyclical,Environmental problems have timeliness and mobility,In addition,the existing laws in China have not clearly stipulated the supporting mechanism of collaborative legislation.Therefore,this paper is based on the guanzhong plain urban agglomeration ecological environment,ecological environment related collaborative legislation laws and regulations,in the study of National People’s Congress and its standing committee of the shortcomings of collaborative legislation,supporting mechanism,to put forward the guanzhong plain urban agglomeration ecological environment collaborative legislation need to establish and improve the effective coordination mechanism between collaborative legislation body,determine the content of environmental collaborative legislation elements,establish collaborative legislation guarantee mechanism. |
