Study On The Legislation Of The Regulations On The Promotion Of Ecological Civilization In Shaanxi Province

In today’s era,the constraints of resources and environment on the development of human society are constantly strengthening.In the context of the new era,green circular development has become the main theme of social development.The construction of ecological civilization is consistent with the theme of current social development,and the relationship between social development and the ecological environment should be coordinated.The Shaanxi Provincial Regulations on the Promotion of Ecological Civilization is a framework regulation that provides programmatic guidance for legislation related to ecological civilization construction in Shaanxi Province and government ecological civilization construction.The local legislation on environmental protection that has been issued in Shaanxi Province still has some shortcomings in promoting the construction of ecological civilization.The relevant legislation on environmental protection that has been issued in Shaanxi Province is relatively scattered and fails to provide a comprehensive framework and overall arrangement for the construction of ecological civilization from a macro perspective.In order to better promote the construction of ecological civilization,legislation should be made for the construction of ecological civilization in Shaanxi Province.This article first discusses the legislative background of the "Shaanxi Province Ecological Civilization Promotion Regulations",analyzes the necessity and feasibility of formulating the "Shaanxi Province Ecological Civilization Promotion Regulations",analyzes its legal difficulties,and explores the legislative path and content of the "Shaanxi Province Ecological Civilization Promotion Regulations".The Chinese practice of Marxist ecological civilization thought,the modernization introduction of traditional cultural ecology civilization thought and the reference to the concept of sustainable development in world civilization together constitute the theoretical basis of Shaanxi ecological civilization legislation.The necessity of formulating the"Regulations on the Promotion of Ecological Civilization in Shaanxi Province"lies in the objective requirements for building ecological civilization,the inevitable requirements for achieving a rule of law society,the important content of a sound legal and normative system for ecological civilization,and the important way to coordinate environmental and economic development;Its feasibility lies in policy support for ecological civilization construction,legal support for ecological protection,objective laws of ecological integrity,and legislative experience provided by local ecological civilization legislation.There are four urgent challenges in the construction of ecological civilization in Shaanxi Province that need to be addressed:the concept of ecological civilization and the rule of law needs to be deepened and strengthened,the legal norm system needs to be sound,the efficiency of rule of law implementation needs to be improved,and the rule of law supervision system needs to be more rigorous.In order to address the aforementioned issues,Shaanxi Province urgently needs a special legislation on ecological civilization to regulate the aforementioned issues.This article summarizes and analyzes the laws and regulations related to ecological civilization in various provinces and cities,and divides the legislative model of ecological civilization into unified and decentralized models.The legislation of the"Shaanxi Province Ecological Civilization Promotion Regulations"should adopt a unified legislative model.This is a scientific and reasonable legislative framework that draws on the legislative framework of other local provinces and cities,combines with the actual situation of Shaanxi Province,and conforms to the actual situation of Shaanxi Province’s ecological civilization.In addition to a legal framework,a good law also requires a complete and specific legal system.The Shaanxi Provincial Regulations on the Promotion of Ecological Civilization should draw on the excellent legal systems of other provinces and cities to form four core legal systems,namely,establishing a strict ecological environment protection system,establishing a legal system for effective utilization of resources,improving the ecological protection and restoration system,and strengthening the ecological environment protection system.This article is based on the legal status and legal challenges of ecological civilization construction in Shaanxi Province,exploring the legislative path and content of the"Shaanxi Province Ecological Civilization Promotion Regulations",in order to provide useful reference for the construction of ecological civilization in Shaanxi Province.
