Research On Legal Protection Measures For The Yellow River Cultural Heritage

The Yellow River cultural heritage is a precious asset of Chinese civilization,and its unique historical background and geographical location determine its characteristics of long history,diverse types,and precious cultural value.On the basis of in-depth research on the Yellow River cultural heritage,further protecting and developing it through legal means is an important practice to establish cultural confidence in the new era.At the same time,cultural heritage is an important component of the artificial environment in environmental law,becoming the focus of research by many environmental law experts and scholars,and constantly enriching its connotation.However,the overall understanding of the Yellow River cultural heritage and specialized research on the legal protection of the Yellow River cultural heritage have just started,and research results are relatively few.Therefore,under the guidance of the overall protection concept,it has certain theoretical value to propose improvement measures for the legal protection of the Yellow River cultural heritage.It is found that although the Yellow River Protection Law of the China has been initially established as a basic legal framework,there are still some problems in the legal protection of the Yellow River cultural heritage,such as the absence of a holistic protection concept,imperfect protection legal system,incomplete protection system content,and imperfect coordination protection mechanism.Based on the analysis of the above problems and causes,the representative American heritage corridor Protected mode and European cultural route Protected mode in the legal protection of cultural heritage are selected for research,and their beneficial experience is used for reference to provide new ideas for the establishment of the guiding concept of cultural heritage protection of the Yellow River and the coordination of legal mechanisms.Through the above research,we attempt to propose improvement suggestions for the legal protection of the Yellow River cultural heritage from two aspects: concept formation and specific implementation,based on foreign experience and domestic protection practices.Firstly,we need to clarify the overall protection concept of the Yellow River cultural heritage.Establish its guiding positioning,with the overall protection concept as the direction,and make dynamic adjustments in accordance with the requirements of the overall protection concept in a timely manner.The second is to improve the legal system for protecting the Yellow River cultural heritage.Develop the "Regulations on the Protection of the Yellow River Cultural Heritage" at the national level to supplement the top-level design of the legislation on the protection of the Yellow River cultural heritage;At the local level,it is necessary to promptly formulate local regulations and combine them with the actual situation of the local Yellow River cultural heritage to carry out legal protection of the Yellow River cultural heritage.The third is to improve the legal system for the protection of the Yellow River cultural heritage.Develop a comprehensive planning system for the protection of the Yellow River cultural heritage,refine the responsibility system for the protection of the Yellow River cultural heritage,and clarify the system of information disclosure and public participation.The fourth is to improve the legal operation mechanism for cross regional and multi departmental coordination.Integrate the current pattern of multi sectoral cross protection,strengthen the cultural heritage protection function of the Yellow River Conservancy Commission of the Ministry of Water Resources,build a cross regional and multi sectoral coordination operation mechanism with the Yellow River Conservancy Commission of the Ministry of Water Resources as the core organization of the Yellow River cultural heritage protection,and use modern means to achieve an information-based operation mechanism in regional and departmental coordination.
