Research On Legal Regulation Of Horizontal Ecological Compensation Agreement In Watershed

Against the backdrop of widespread practice of horizontal ecological compensation agreements in river basins,it has become inevitable to use legal norms to regulate their development.Clarifying the concept,legal characteristics,and legal nature of the horizontal ecological compensation agreement in the watershed is a prerequisite for its legal regulation.The horizontal ecological compensation agreement for the watershed can be divided into a bidirectional compensation model and a set of ecological compensation fund models,which are mainly adjusted by normative documents and local regulations.At present,the legal regulation of horizontal ecological compensation agreements in river basins faces three difficulties: non-standard procedures,lack of legal protection,and unclear effectiveness.The interstate river agreements in the United States share similarities with the horizontal ecological compensation agreements for watersheds,providing valuable experience for negotiation,approval,and dispute resolution.The article addresses the difficulties faced by the legal regulation of horizontal ecological compensation agreements in river basins,and based on the actual situation in China and the experience of the United States,proposes the following suggestions: establishing public participation and approval procedures in procedures,incorporating government information disclosure scope and constructing dispute resolution methods in legal protection,and introducing relevant laws to confirm the binding force of agreements on contracting parties and distinguish the effectiveness of agreements at different levels.
