Study On The Mechanism Of Cooperative Legislation In Dongting Lake Basin

As the construction of ecological civilization continues to advance,collaborative legislation,as a new type of legislative path that has been explicitly stipulated in the law to facilitate coordinated development among localities,can effectively alleviate the irreconcilable contradiction between the fragmentation of environmental governance and the overall ecological environment caused by the traditional local legislation dominated by administrative divisions in China.As the second largest freshwater lake in China,the legislative protection of Dongting Lake is related to the achievement of ecological management in Yangtze River basin and the demonstration of the national ecological civilization construction.By carefully interpreting the connotation and characteristics of collaborative legislation,we can conclude that the path of collaborative legislation can provide more comprehensive legislative support for the protection and development of the Dongting Lake basin,analyze the applicability of constructing a collaborative legislative mechanism in the Dongting Lake basin,and prepare a detailed pavement for the construction of a collaborative legislative mechanism in the Dongting Lake basin.Starting from the existing legislative basis of the Dongting Lake basin,through the interpretation of the existing local legislation related to the Dongting Lake basin,along with the continuous innovation of theories such as the theory of synergy,ecological concepts and environmental protection principles,as well as the confirmation of synergy legislation by national legal policies and the results of the central and local practice of synergy legislation,we conclude that the Dongting Lake basin guarantees the long-term implementation of synergy legislation must rely on We conclude that the construction of collaborative legislation mechanism in the Dongting Lake basin is necessary and feasible for the implementation of collaborative legislation mechanism in the Dongting Lake basin.By studying the concept and measures of the construction of the international well-known basin legislative mechanism of the Tennessee River,Biwako and Rhine River,we summarize and absorb the experiences that are beneficial to the legislation and governance of the domestic basin;at the same time,we draw on the practice of collaborative legislation in the basin that has been carried out in the Wei River,Youshui River,Min River and Chishui River in China,summarize and analyze the differences in the paths of collaborative legislation that exist in the experiment of the construction of collaborative legislative mechanism implemented in the basin in China,and provide The study will also help us to choose the appropriate collaborative legislative path for the Dongting Lake basin collaborative mechanism.The construction of a collaborative legislative mechanism in the Dongting Lake basin is an important step in promoting collaborative legislation in the Dongting Lake basin,and can also guarantee the normalization of collaborative legislation in the Dongting Lake basin in the future.Through an exhaustive analysis of four aspects of the Dongting Lake Basin legislative mechanism,namely,legislative subject,consultation path,regulation sorting and supervision system,we explore the path of collaborative legislation under the construction of the Dongting Lake Basin collaborative legislative mechanism,and on the basis of the newly revised Legislative Law,we creatively propose that the two provinces should collaborate to legislate the "Regulations on the Protection of Dongting Lake in Hubei Province" or the two provinces should jointly legislate and submit the "Regulations on the Protection of Dongting Lake" to the central government.Based on the newly revised Legislative Law,the two provinces have proposed two outcomes of the Dongting Lake Protection Regulations or the joint legislation of the two provinces to request the central government to issue the Dongting Lake Protection Regulations,with a view to creating effective protection for the Dongting Lake Basin system.
