Public participation in environmental impact assessment refers to the participation of relevant units,experts and the public in environmental impact assessment activities related to their environmental rights and interests through certain ways and means,following certain procedures.Since the "Environmental Impact Assessment Law" promulgated by our country in 2002 established the public participation system of environmental assessment,making project planning or approval decisions more scientific in the interests of the public,has made remarkable results,but the defects of the system have gradually appeared.Lack of clarity on the scope of public participation in EIA projects;The public participation method is simple,and traditional methods such as hearing and questionnaire survey are adopted,which cannot allow the public to choose independently among the diversified methods.Inadequate disclosure of environmental information,unable to timely release EIA information.In view of the above problems,combined with the foreign experience and the actual situation in our country,it is proposed that the public participation in environmental impact assessment should be diversified.Detail the ways of public participation in environmental impact assessment;Expand the scope of public participation in EIA and ensure the consistency of the scope of public participation and EIA;Establish a two-way information disclosure system,and specify in detail the subject of information disclosure obligations,the procedures to be followed and the legal responsibilities to be borne if the information disclosure obligations are not performed according to law;At the level of relief mechanism,improve the feedback mechanism of public participation,expand the scope of plaintiff qualification in EIA cases,standardize the proof standards for EIA cases,standardize the discretion of judges,conduct substantive judicial review of EIA cases,and promote the coordinated development of economy,society and environment. |
