Study On Public Participation System Ofrural Water Pollution Prevention Andcontrol

In recent years,although the level of economic development in rural areas has been gradually improved,the problem of water pollution has been gradually exposed.The harm caused by water pollution is also well known to the public.Therefore,citizens take the living environment as one of the important standards to measure the quality of life.Currently,there are many problems in the ecological environment of rural areas.In the process of completing the paper,through collecting data,watching online videos and information,and visiting the field,I deeply realized that water pollution has seriously restricted the development of rural areas,including the improvement of public production and living standards,and the situation of water pollution is quite severe.Due to the negative impact of the urban and rural dual system,even though several laws and regulations on environmental protection have been revised successively,water pollution prevention in rural areas in many aspects,such as: legislation,practice and so on,there are still a variety of problems and predicament.Such a situation is not conducive to improving the ecological environment and public living standards,nor is it conducive to the construction of national ecological civilization.Based on the concept of rural water pollution and public participation,this paper analyzes the necessity of public participation in rural water pollution prevention and control,states the legislative status and practice status of public participation system in rural water pollution prevention and control,based on environmental rights theory and environmental justice theory.To summarize our country rural water pollution prevention public participation system existing legal not to confirm the civil environmental rights,water environment information disclosure system imperfect,public participation legal incentive mechanism imperfect,civil public interest litigation system lack of citizen environmental problems,through the study of the United States,Japan,the European Union rural water pollution prevention experience,The suggestion to improve the public participation system of rural water pollution prevention and control is put forward,which can not only alleviate the situation of rural water pollution,but also benefit the implementation of national ecological civilization strategy.However,to improve the public participation system of rural water pollution prevention and control in line with our national conditions,we must first establish the citizens’ environmental rights in the legislation,if the "environmental protection law" stipulates the citizens’ environmental rights,it will be taken as the power base of specific environmental rights,from which can create various specific environmental rights;Secondly,we should improve the water environment information disclosure system,which affirms and guarantees the farmers’ right to know about the environment and recognizes the public’s right to criticize and make suggestions.Only by understanding the environmental situation can farmers participate in environmental protection in a targeted way.Thirdly,it is to improve the incentive mechanism of public participation.The incentive focuses on encouraging farmers to control pollution and protect water quality at the source,which can effectively reduce the later treatment work and facilitate the implementation of the public participation system.Finally,the environmental public interest litigation system should be established.The environmental public interest litigation system can further escort the development of citizens’ environmental rights,and the environmental rights themselves provide the legal theory and power base for the environmental public interest litigation system.
