Study On The Legal System Of Prevention And Control Of Rural Solid Waste Pollution In Our Country

Since the development of the rural revitalization strategy,the rural economy has developed rapidly,and the living water of rural residents has been greatly improved,but at the same time,the environmental pollution in rural areas has become more and more serious.Among them,the pollution of rural solid waste to the environment is more and more obvious,the pollution of rural solid waste has caused the physical health reality of rural residents or hidden harm,it also has a serious negative impact on the sound and sustainable development of rural economy.At present,the prevention and control of solid waste pollution in rural areas of our country has been put on the agenda,but still need to strengthen efforts.Based on the detailed investigation and study on the status quo of solid waste pollution in rural areas,this paper summarizes the previous experience of solid waste prevention and control,and puts forward the feasible methods of preventing and controlling solid waste pollution in rural areas at the legal level,thus effectively prevent and control rural solid waste pollution,protect the rural environment,to the rural residents a beautiful and clean living environment to build a force.This paper is based on the law of the People’s Republic of China on the prevention and control of environmental pollution by solid waste(revised in 2020)and the opinions on the implementation of the law of the People’s Republic of China on the prevention and control of environmental pollution by solid waste promulgated by the Ministry of Rural Agriculture,to analyse the existing problems in the content,enforcement and judicial system of our country’s legislation on the prevention and control of solid waste pollution in rural areas,taking into account such legal norms as the Local ordinance laws and regulations introduced in the prevention and control of such pollution in rural areas,put forward the reasonable legal suggestion,provide the legal safeguard for our country countryside solid waste pollution prevention and control.First of all,this paper interprets the rural solid waste,analyzes the theoretical research on the rural solid waste prevention and control,and analyzes the valuable theory in the process of environmental control,with a view to our country’s rural solid waste pollution prevention and control process in the application of the existing theory into the legal system construction.Secondly,in view of the large quantity,variety and distribution of rural solid waste,combined with the actual harm of solid waste to the environment,to further clarify the rural solid waste pollution prevention and control of the necessity and urgency.Then,this article has carried on the reorganization to our country at present regarding the solid waste law and regulation,from the analysis of our country’s current solid waste pollution prevention and control in rural areas of the existing low legal status,the legal system is not complete,the rights and obligations of rural residents are not equal;In the process of law enforcement,the main body is not clear,the grass-roots people’s government has no clear authority,the villagers’ self-government ability is poor,the participation of rural residents is low;It is difficult to safeguard the rights of rural residents after the environmental rights are damaged in the judicial process,the link between the public interest litigation system and rural residents is not in place,and the environmental judicial system is not perfect.Finally,this paper analyzes the concrete legal problems of solid waste pollution prevention and control in rural areas from the aspects of legislation,law enforcement and judicature.Some legal suggestions are put forward in the aspects of perfecting the legal system of solid waste pollution prevention and control in rural areas,improving the law enforcement ability of solid waste pollution prevention and control in rural areas,and strengthening the judicial supervision in the process of solid waste pollution prevention and control in rural areas,in order to promote the rural solid waste pollution prevention and control work progress.
