Research On The Application Of Ecological Restoration Resp Onsibility In Environmental Administration And Environme Ntal Litigation

In recent years,the academic circle has carried out a lot of research on ecological restoration theory.Related theories have gradually penetrated into specific fields such as the application of ecological restoration in environmental administration and environmental litigation from the analysis of the concept and goal of ecological restoration.Controlling ecological environmental pollution and restoring the damaged ecological environment are urgent problems in our country.However,ecological restoration is not a simple pollution control,it has its comprehensive and technical characteristics,and will encounter many obstacles in the process of restoration practice.Therefore,in the process of ecological restoration,it is necessary to have its legal procedures and strict norms,and to improve the legal system of ecological restoration is also a top priority for relief of ecological environmental damage.Through the summary analysis of the results of a large number of cases and the analysis of the current specific application of ecological restoration,it is found that there are still many problems in environmental administration and environmental litigation in China,the relationship between ecological restoration administrative order and administrative punishment is unclear,the environmental administrative law enforcement activities lack effective supervision,and the restoration responsibility and compensation responsibility are difficult to meet the needs of environmental restoration.The execution of judgment restoration is difficult and inefficient.These problems involve not only differences in theory,but also differences in understanding of practical operation and application.To solve these problems,we should put forward corresponding countermeasures from the legal orientation of environmental administration and environmental litigation,as well as the practical problems arising from the specific application of ecological restoration.China’s ecological restoration legal system should implement the applicable principle of "administrative organs as the leading,court trial as the supplement",improve the ecological restoration administrative order system standards,and improve the legal system of ecological restoration administrative performance.At the same time,strengthen the supervision and restriction of administrative law enforcement activities.
