Analysis Of Environmental Administrative Law Enforcement Of Agricultural Production Pollution

Agricultural production depends on the atmosphere,water,land and other natural resources,but also depends on national policies,agricultural technology and other social resources.The agricultural production process will pollute the ecological environment in different degrees and it is difficult to recover.The production and aggravation of agricultural production pollution is the biggest obstacle to the sustainable and sound development of agricultural production,therefore,while developing agriculture,we must protect the agricultural ecological environment.It is necessary for the administrative law enforcement of agricultural environmental protection to do something to ensure the good development of agricultural production environment and the steady progress of agricultural economy.This paper is based on the administrative enforcement methods of agricultural environmental protection,which are based on the characteristics of the existing agricultural production environment,such as many pollution sources,a wide range of pollution areas,complicated and difficult administration and so on,deeply analyzing the particularityand difficulty of agricultural environmental administrative law enforcement different from General Administrative Law enforcement,focusing on the study of whether the environmental law enforcement system in the whole agricultural production process has the power structure and the operation process in the operation of law enforcement,and analyzing its deep-seated reasons,finally,it summarizes and integrates the better optimization methods of environmental administrative law enforcement against agricultural pollution.This paper mainly expounds the realistic background of the urgent need to promote the agricultural environmental administrative law enforcement,and analyzes the present situation of the agricultural environmental law enforcement in China,which is generally good but still difficult to enforce,through the analysis of the typical local agricultural environmental law enforcement,it is concluded that the current agricultural environment management system and law enforcement operation mechanism mainly exist such outstanding problems as imperfect law enforcement system,imperfect law enforcement basis,low law enforcement methods and means effectiveness,lack of law enforcement supervision mechanism and unclear responsibility investigation.The causes of these problems,it mainly lies in the following aspects: neglecting the ecological environment protection for a long time,losing the position of the environmental protectionmanagement system for a long time,being difficult to balance the ecological environment benefits and the agricultural economic benefits in the rural areas,not adapting the environmental protection policy to the economic development,imperfect public participation mechanism caused by the lack of the national environmental protection consciousness,the agricultural development mode and the level of economic development among the regions,etc..Based on the above analysis,the author believes that in order to better develop the administrative law enforcement of agricultural environment,efforts must be made to deepen the reform of the comprehensive law enforcement and management system of Agricultural Environmental Administration,from institutions to personnel to law enforcement functions,to improve the supervision system of agricultural environmental law enforcement from top to bottom and from inside to outside,to regulate agricultural environmental law enforcement behavior in a multi-form and long-term way,and to ensure that the legal responsibility of agricultural environmental law enforcement is clear.
