Study On Legal Issues Of Water Resources Protection In The Yellow River Basin

The Yellow River is the mother river of the Chinese nation and the cradle of the Chinese nation.Since the Central Committee of the Communist Party of China and the State Council issued the Outline for Ecological Protection and High-quality Development of the Yellow River Basin in October 2021,the issue of ecological protection in the Yellow River Basin has attracted much attention,and strengthening the ecological protection and high-quality development of the Yellow River Basin has become the focus of the work of various departments.Water resources as a strategic resource,most of the world is experiencing the same problem of water shortage as China,the protection of water resources in the Yellow River Basin has always been the focus of China’s ecological environment planning,in the new economic development period,the Yellow River Basin water resources problem has a new situation,natural conditions and human impact led to water shortage and then promote the Yellow River Basin internal water supply and demand contradiction aggravated,water pollution is still a major problem plaguing the governance of the Yellow River Basin.It has become a matter of course to adjust and solve the water resources problems in the Yellow River Basin through the legislation and implementation of laws and regulations.From the perspective of the legal system of water resources protection in the Yellow River Basin,this paper concludes that there are still areas that need to be refined in the development and protection of water resources in China at this stage through literature analysis and comparative analysis,combined with the specific provisions of China’s laws and regulations on water resources.First of all,Based on the current situation of water resources in the Yellow River Basin,this paper analyzes the current situation of water resources utilization and protection in the Yellow River Basin,and highlights the importance of legal protection of water resources in the Yellow River Basin.Secondly,by analyzing the current main Legal issues of water resources in the Yellow River Basin and the discussion of their causes,the problems that need to be solved urgently in the protection of water resources in the Yellow River Basin in China are summarized.Thirdly,on the basis of the existing problems and their causes,the systems and measures for water resources protection at home and abroad are discussed,and the advanced experience and methods adopted are summarized,and applied to the legal construction of water resources protection in China.Finally,in the previous part,the discussion on the problems and causes of water resources protection is combined with advanced experience at home and abroad,so as to put forward: First,it is necessary to accelerate the connection and refinement of legal norms for water resources protection,echo the implementation of the Yellow River Protection Law,jointly handle water resources protection matters,improve the regulation and control of water resources management,optimize the pilot work of water resource tax,and promote the process of water conservation in the whole society;Second,it is necessary to accelerate the resolution of the contradiction between supply and demand of water resources,strengthen the supervision of water intake rights through the confirmation of water rights,and promote the market allocation of water resources led by the government to improve the utilization rate of water resources;Third,to do a good job in water resources governance,it is necessary to strengthen coordination and cooperation between various regions and departments,improve the distribution of benefits,increase the enthusiasm of all departments to participate in water resources governance,jointly build an information sharing system,make water resources information transparent and convenient,so as to deal with problems in a timely manner,so as to jointly improve the large-scale supervision of the Yellow River Basin.Fourth,it is necessary to do a good job in ecological compensation in the Yellow River Basin,complete the ecological compensation model,optimize the compensation mechanism,and promote the sustainable development of the Yellow River Basin.
