Research On Reproductive Rights Of Single Women In My Country

Fertility is the instinctive behavior of human beings.The object of this study is the reproductive right of single women.The single women studied in this paper refer to unmarried single women without a partner,divorced and widowed single women without children,who have no intention of marrying for the time being,and wish to realize their reproductive rights when they are single.This paper focuses on whether the law of our country should give single women reproductive rights and how to give single women reproductive rights.In addition to the introduction and conclusion,this paper is divided into four parts to discuss the reproductive rights of single women in China.The first part is an overview of the reproductive rights of single women.This part begins with the concept,content and definition of single woman's reproductive right,defines single woman's reproductive right,probes into the social and personal significance of giving single woman's reproductive right,and combs the obstacles to the realization of single woman's reproductive right.The second part,the academic dispute and comment on the reproductive rights of single women in China.This part starts with who is the main body of reproductive rights,and discusses whether single women can enjoy reproductive rights.This paper analyzes the different views of single women's reproductive rights in academic circles,and emphatically demonstrates the rationality of the legal right of single women to bear children.The third part,single women's reproductive rights within and outside the legislative investigation and reference.In this part,the author concludes that there are three kinds of legislation models: full inclusion model,half inclusion model and complete prohibition model.This paper holds that our country can not copy these three models,we should draw on the experience of the above three models,and design a single female fertility system in line with the national conditions of our country,that is,full inclusive model with limited conditions.The fourth part,China single female fertility system design.This paper first analyzes the relevant legislation of our country,studies the background and effect of the promulgation of the regulations on population and Family Planning of Jilin Province in 2002,and objectively evaluates its progress and limitation.On this basis,the author clearly puts forward three principles that single women must adhere to: the principle of adequate protection of children,the principle of public order and good customs,and the principle of no abuse of rights.Following and implementing these principles,this paper puts forward four conditions for the reproductive rights of single women in China,first,age conditions,that is,single women who reach the average age of first marriage of local women +1 year old.Second,physical conditions,that is,to meet the physiological requirements of single women's fertility(no unsuitable for reproductive mental diseases hereditary diseases)and good mental health requirements.Third,economic conditions,i.e.economic standards sufficient to guarantee the growth of children,or a single woman's own income of not less than 5times the local minimum wage or 10 times the local minimum standard of living,or a single woman's parents who can provide sufficient financial support for their children,are considered to be the economic conditions for single births.Fourth,educational conditions,single women must have higher education(all forms)and obtain a diploma.Qualified single women shall be issued by the family planning department.Single women have the right to single birth through qualified reproductive auxiliary medical institutions.In a word,this paper holds that the law of our country should not only safeguard the reproductive right of single women,but also ensure the right of healthy growth of minor children,and ensure that the mainstream marriage and reproductive function is not impacted.
