Research On The Legal Protection Of Single Woman’s Bearing Rights

As a new group of single women,their claims for related rights should be protected by law rather than restricted.Whether single women should enjoy the right to reproductive rights,the problems that may arise from their realization of reproductive rights,how to deal with these problems,and how to protect the exercise of reproductive rights of single women have become issues worthy of our discussion.In view of this,this article takes the protection of single woman’s reproductive rights as the research object.The realization and protection of single woman’s reproductive rights are legal issues that we need to face squarely.This article takes the protection of single woman’s reproductive rights as an entry point,analyzes the obstacles in its protection,and proposes solutions to related obstacles,and uses this as a basic idea to discuss the views of this article.The article is roughly divided into three parts to discuss the research on the legal protection of single woman’s reproductive rights,namely,the legal overview of single woman’s reproductive rights,the obstacles to the protection of single woman’s reproductive rights,and the legal protection path design proposed against the obstacles.First of all,the author introduces the concept and attributes of single woman’s reproductive rights through the elaboration of reproductive rights.On this basis,the author conducts a preliminary discussion on the protection of single woman’s reproductive rights,taking the country’s first "frozen eggs" case as the introduction.It discusses the rationality of the protection of its rights,discusses the rationality,and compares with the issue of single man’s reproductive rights,and analyzes the problems caused by single man’s reproductive rights.The status qua of protection within and outside the domain of single women is described.Secondly,the author deals with the obstacles of the administrative system suffered by the special group of single women in realizing their reproductive rights,the inability to enjoy social insurance,and the obstacles in the system of being levied on social maintenance;the subject and content of childbirth are not clear,and the law on childbearing by single women Obstacles to the definition of status;the obstacles to the application of human assisted reproductive technology required for the realization of reproductive rights are analyzed.Finally,based on the above obstacles,a legal protection path is proposed.First,to free childbirth from the marital framework at the legal level.Separate childbirth from the marriage framework based on the Family Planning Law,so that childbirth is no longer restricted by the marriage framework.At the same time,it guarantees that single women enjoy maternity insurance after giving birth and cancels the collection of social support fees for single women to better protect The realization of single woman’s reproductive rights.Second,clarify the subject and content of childbirth in legislation,refine the criteria for defining children of single women,and no longer rely solely on marriage as the basis for judgment.The author classifies the children of single women as "single children",which means the children of single women.Third,improve the legislation of human assisted reproductive technology,and incorporate egg freezing technology into the human assisted reproductive norms for restraint.Single women are allowed to use human assisted reproductive technology,but also put forward strict restrictions on the application of this technology.While protecting the reproductive rights of single women,it also protects their rights to have children and prevents single women from abusing their reproductive rights.In short,the enjoyment of the reproductive rights of single women requires both legislative and technical support.Reasonable restrictions on the basis of the above support not only effectively guarantee the reasonable enjoyment of reproductive rights of single women,but also avoid problems that may arise after granting single women the right to reproduce.
