Research On Regulatory Legal Issues Of Blockchain Food Traceability Information Platform

Blockchain food traceability information platform,as a popular application at the moment,provides complete and true food data with the help of the "data guarantee" feature of blockchain technology,which can effectively meet the needs of consumers to know food information.As soon as it enters the market,it is chased by capital,all kinds of traceability food applications are constantly landing,and major blockchain traceability platforms are developing rapidly.However,compared with the rapid development of the market,the speed of regulatory rule making and regulatory theory research is somewhat slow.On the one hand,China has not promulgated special laws to regulate the application of blockchain food traceability.On the other hand,what kind of regulation is needed for new applications of blockchain? It is also not clear in the theoretical discussion.But as a guide to practice,theory is indispensable.On the one hand,with a clear theory and normative guidance,the specific application of blockchain can have a better development prospect and a greater space for development.On the other hand,the application of blockchain food traceability has not been put into the market for a long time,and its potential technical risks and legal issues have not yet fully emerged.The public is not aware of its risk,and it is easy for criminals to use the application of blockchain to harm the rights and interests of consumers and the public.Therefore,this paper will comb through the legal problems existing in the application of blockchain food traceability,and put forward countermeasures by summarizing the regulatory suggestions of domestic and foreign scholars and successful practices in the supervision of blockchain application outside the territory,so as to put forward specific and feasible suggestions for the improvement of the regulatory system of blockchain application in China.This paper consists of five parts.The first chapter,as the introduction of the paper,mainly introduces the research background,research significance and research status of the blockchain food traceability information platform.First of all,the application of blockchain food traceability has been recognized at the national level,advocated by policies of various provinces and cities,and chased by capital craziness.However,there is still no clear conclusion on how to regulate it.Secondly,it analyzes the theoretical significance of the research content in the application of blockchain supervision and the practical significance in the application of blockchain food traceability regulation and operation.Finally,the research status of the regulatory issues of blockchain food traceability information platform at home and abroad was summarized and analyzed,and the similarities and differences between domestic and foreign scholars on the regulatory opinions of blockchain application were summarized and analyzed.The second chapter summarizes the basic legal principles of the food traceability information platform of blockchain.First,complete the definition of the concept of food traceability application of blockchain.Firstly,the concept of block chain is defined,and the characteristics of block chain technology are introduced.Secondly,the concept connotation of food traceability system is clarified,and the existing problems of food traceability information such as inconsistent collection standards and difficulty in information sharing are sorted out.Finally,the concept of blockchain food traceability information platform is defined,and the legal nature of its information certification work is analyzed.Second,the legal value of blockchain food traceability information platform in maintaining fairness,improving efficiency and safeguarding consumer rights in the application process is analyzed and discussed.The third chapter analyzes the deficiencies of the current regulatory system of blockchain food traceability information platform.To sort out the conflicts and contradictions between the blockchain food traceability information platform and the current regulatory regulations,as well as the problems existing in the internal operating process of the blockchain application,such as the lack of standardization in the fields of information collection,information entry and information management.The fourth chapter puts forward targeted suggestions on improving the supervision system of blockchain food traceability information platform.By sorting out the experience and practices of preventing and resolving the risks of blockchain application outside the region,and summarizing the beneficial opinions of domestic scholars on the supervision of blockchain application,this paper puts forward feasible suggestions for improving the supervision system of China's blockchain food traceability information platform.For example,improve relevant legislation to provide the institutional basis,introduce the access system of business entities,formulate specific standards for the regulation of blockchain application,warn consumers about risks,and adopt sandbox regulation to deal with unpredictable risks.The fifth chapter gives the conclusion of this paper.Blockchain food traceability information platform,as an innovative application in the field of food traceability,is not only conducive to improving the quality of food information disclosure in China,but also conducive to encouraging the practitioners of the food industry chain to work down-to-earth,seek truth from facts and provide quality food.However,the blockchain technology is in a period of rapid development,and its technology is still improving and changing.The risks and problems implied by the application of blockchain are also changing constantly.Therefore,the regulatory system of food traceability application of blockchain must give consideration to the value of encouraging innovation and development and effectively preventing risks.
