Food safety problems, such as poison milk powder, gutter oil, Sudan red and clenbuterol, have happened frequently in China in recent years. The happening of those problems are warning people about food safety. In China, however, the unsound tracking system in the Food Safety Law, along with the lower legal hierarch and the absence of mandatory rule and effective technical regulation, have resulted in a waste of time and energy in tracking and supervising and the frequent happening of food safety problems. Currently, comparatively well-developed food safety tracking legal systems have been established in European and American countries. In those countries, advanced food safety tracking management systems have been widely applied in a wide range of food manufacturers, supermarkets, retail stores and food safety supervision authorities. As a result of the seamless supervision on food safety by the well-developed tracking and management systems, the food in European and American countries are very safe, which is something China should reflect on and learn from.This paper, by regarding the rights and obligations of subjects of food safety tracing as the principal line, has analyzed and studied the food safety tracing legal system of China and come up with relevant legislative suggestions according to different subjects of food safety tracing. Moreover, this paper has come up with some other suggestions, including:determine the principles for managing food safety tracing; practice differentiated management according to features of different tracing subjects; set up a transitory period for food safety tracing; perfect the punitive food compensation system; implement food safety tracing "accountability" system; establish a national unified food safety trace and query service system; force relevant food enterprises in the field to practice electronic supervision code system.
