Research On The Power Of Administrative Punishment Of Grassroots Governments

The reform practice of empowering or delegating power to the grass-roots government has been a focus of the reform of my country’s grass-roots political system in recent years.Since the 19 th National Congress of the Communist Party of China,the law enforcement status of grass-roots governments has been elevated to an important level in the construction of a country under the rule of law,and it is clear that problems should be resolved at the grass-roots level.The new "Administrative Punishment Law" adds the provision of "delegating administrative punishment powers",allowing the administrative punishment powers to be accurately transferred to the grass-roots governments,clarifying their administrative law enforcement status,accelerating the construction of my country’s administrative law enforcement subject system,and realizing the integration of responsibilities of county and township governments.,and promote grassroots governance to follow the law and have laws to abide by.However,in the process of granting administrative punishment power to township governments,there are still problems such as unclear responsibilities,vague qualifications of law enforcement subjects,and lack of law enforcement and supervision capabilities.Analyze the root causes of the above problems,grasp the key points of the problems and propose solutions,develop solutions,and at the same time follow the development characteristics and economic development levels of each region,and further adapt measures to local conditions and events.Respect the differentiated expressions that exist in practice,ensure the characteristic development and differentiated expressions of each region,clarify the comprehensive law enforcement powers that township governments can exercise,focusing on administrative penalties,and enhance the autonomy of grass-roots governments.When power is exercised according to law,it must be supervised according to law.Supervise the exercise of power of grassroots governments from three aspects: higher-level supervision,social supervision,and broadening of relief channels,and make overall plans to promote the lowering of the focus of grassroots governance and the decentralization of punishment power to townships and towns.
