Investigation And Research On The Status Quo Of Local Legislation In The Autonomous Prefectures Of Guizhou Province

At present,the people’s expectation of the law is not whether there is a law or not,but whether the law is good,whether it works or not,and whether it can solve the problem.Improving the quality of legislation and making good laws are the most important tasks of legislation at present and in the future.The laws and regulations enacted and implemented by NPC are national and universal.In this context,in 2015,the National People’s Congress amended the legislative law of the people’s Republic of China,expanded the legislative authority of local state power organs,and made the local legislative power truly implemented.The so-called economic basis determines the legal system,which is the reflection of the economic basis.The level of legislation is often in line with the level of local economy.Therefore,the study of Qiannan Prefecture’s local legislative work plays an important role in guiding and improving the legislative work of other autonomous prefectures.This paper tries to elaborate and analyze the current situation of local legislation in Qiannan Prefecture,the combing of existing laws and regulations,and the typical problems in the implementation of some regulations,and put forward some suggestions to improve the problems,so as to contribute to the development of local national rule of law in China.This paper is divided into five parts:The first part is the introduction of this paper.The author expounds the differences between autonomous legislation and local legislation,the current situation of domestic and foreign legislation and the current situation of domestic research.This paper expounds the necessity of the difference between autonomous legislative power and local legislative power,because Qiannan Prefecture is a minority autonomous prefecture,so it has both autonomous legislative power and local legislative power.First of all,the author clarifies that the main research direction of this paper is the local legislative power by explaining the difference between the autonomous legislative power and the local legislative power.The author analyzes the necessity and practical value of the research on the local legislation of Qiannan Prefecture by simply comparing the local legislative power at home and abroad and summarizing the current situation of the research on the local legislation at home and abroad.The second part: the author mainly introduces the research situation,mainly for the purpose of research,research process and research methods are briefly described.This survey mainly adopts two methods of literature analysis and interview,and analyzes the necessity of making local laws and regulations by collecting relevant documents of legislation research and laws and regulations of Qiannan Prefecture.At the same time,through interviews with the main leaders of Qiannan Prefecture People’s Congress,we have a deeper understanding of the local legislative work in Qiannan Prefecture.The third part: the third part is the analysis of the main problems and causes of the local legislation in Qiannan Prefecture.The author thinks that there are still some problems in the content and procedure of Qiannan local legislation.The inadequacy of the legislative content is the inadequacy of the content of the local legislative structure.At present,in the content of the local legislation of Qiannan Prefecture,the legislation of urban and rural planning is still blank,and the proportion of the legislation of historical and cultural protection is less,which does not meet the actual requirements of the economic and social of Qiannan Prefecture.The main problems in the legislative process are that the public participation is not high enough and the legislative evaluation is not carried out.The fourth part: the fourth part is the corresponding suggestions put forward by the author in view of the shortcomings of the local legislation in Qiannan Prefecture,mainly including two aspects: enriching the legislative content and improving the legislative technology.Specific suggestions are as follows: 1.Formulate urban and rural planning regulations according to local conditions;2.Establish and improve the legal mechanism for historical and cultural protection;3.Improve public participation;4.Improve the local legislative evaluation mechanism;5.Improve the deliberation quality of the Standing Committee.
