| Online short-term rental of houses is a kind of sharing economy developed by relying on "Internet +" and a new type of business model in the accommodation industry.At present,with the application of big data technology and the popularization of various smart phones,the development of online short-term housing rental has good technical support.Relying on the development wave of the sharing economy has also brought good development opportunities,and there are more and more idle houses.It also provides conditions for short-term rental housing.However,because there are different business models,the legal relationship involved is more complicated,and traditional civil and commercial laws are difficult to regulate.Moreover,compared with some foreign countries that developed online short-term rental of houses earlier,our country’s adopting an attitude of encouraging development,but the legal regulation on it is obviously insufficient,so it also encountered many regulatory difficulties in its development.Therefore,this article starts with the difference between online short-term rental of houses and traditional house leasing and traditional hotel industry,analyzes the problems in the legal regulation of online short-term rental of houses,and then combines the regulatory experience of some foreign countries to summarize the realization of online housing in our country suggestions for the healthy and orderly development of short-term rentals.The full text is mainly composed of the following five parts:The first part is to introduce the related concepts of online short-term rental of houses,including analyzing its characteristics,comparing it with traditional house rental and traditional hotel industry,so as to better understand what is online short-term rental.The second part is to analyze the main business model of online short-term rental of houses in our country and the legal relationship between the participants.Since online short-term rental has the intervention of short-term rental platforms,the legal relationship under different business models will also be different.The third part is to analyze the current legal and regulatory problems of online short-term rental of houses in our country,and elaborate on the three aspects of online short-term rental subjects,platforms and supervision.The fourth part is to analyze the foreign legal regulations on online short-term rental of houses.By analyzing the regulatory experience of the United States,the United Kingdom,France,and Japan on online short-term housing rentals,suggestions for promoting the development of online short-term housing rentals in our country are summarized.The fifth part is based on the analysis of the problems in the legal regulation of online short-term rental of houses in our country and learning from the experience of foreign online short-term rental laws and regulations,and put forward suggestions to improve the legal regulations of online short-term rental in our country,and from the online short-term rental main subjects,platform,supervision these three aspects are discussed in detail. |
