Research On The Legal Regulation Of Online Short-term Rental In My Countr

With the sharing economy sweeping the world,the short-term rental market has begun to enter people’s vision.Since the State Council introduced new policies to promote tourism consumption in 2015,the scale of short-term rental market has been growing,especially in the online short-term rental industry.Online short-term rent,as an emerging industry in the Internet era,has rapidly promoted the development of China’s economy,but the consequent legal problems have become increasingly prominent.Because different regions in China have different demands for the online short-term rent industry,local governments have issued corresponding policies one after another to regulate it,but the central government does not have a unified standard,which leads to the chaos of the online short-term rent operation market.Therefore,in order to make the online short-term rental industry in China more healthy development,more standardized operation,and more legal supervision,it is very important to strengthen the research on its legal regulation issues.This paper analyzes the practical problems at different levels of online short-term rent,such as legislation,justice and law enforcement,draws on the different regulatory rules of online short-term rent industry in various regions of the United States,analyzes the relevant problems of legal regulation of online short-term rent in China,and summarizes my own views on this issue.In addition to the introduction and conclusion,this paper is divided into four parts:Part Ⅰ: Firstly,it introduces the concept and characteristics of online short-term rent,and then compares online short-term rent with traditional hotels,analyzes the similarities and differences between them,and then defines the research scope of this paper.Next,I will introduce three main modes of online short-term rent transaction,analyze the advantages and disadvantages of each mode,and lay the groundwork for the following.Part Ⅱ: Firstly,the legislative and practical status quo of legal regulation of online short-term rent in China are summarized,and the main dilemmas faced by legal regulation of online short-term rent in China are analyzed in combination with the two,specifically including: The legal regulation system of online short-term rent is not perfect,the management of online short-term rent platform is chaotic,the lack of effective dispute mediation mechanism,the lack of effective supervision mechanism,and the rights and interests of consumers can not be guaranteed.Part Ⅲ: Firstly,it introduces the current legal regulation status of online short-term rent in the United States,specifically including the regulatory rules of American state governments on online short-term rent,the responsibility of short-term rent platform and the regulation of network platform in Article 230 of Communications Standards Act.Based on the practical status of legal regulation of online short-term rent in the United States,it summarizes the reference for China.Part Ⅳ: Suggestions on perfecting the legal regulation of online short rent in China.Specific include: consummates our country the main regulatory documents in the field of online short rent,strengthen the supervision of short rent platform,perfect short rent online dispute resolution mechanism,establish a complete professional regulators and so on.
