Research On The Application And Optimization Of Artificial Intelligence In Judicial Trials

Since the founding of new China,the legal construction in China has improved in twists and turns.As we all know,judicial trial is a means to achieve judicial fairness and justice,and is also one of the important standards to measure the level of a country’s rule of law.As mentioned in the report of the 19 th CPC National Congress,the deeper integration of artificial intelligence,big data,blockchain and other technologies with China’s real economy will be actively promote in the next step.In the new round of scientific and technological revolution,China’s judicial cause should firmly grasp the opportunities of intelligent,information and modernization.This paper attempts to discuss how to use artificial intelligence technology to promote judicial ability under the background of promoting judicial justice.The artificial intelligence plays the positive function in the judicial trial,while has shortages and disadvantages applied to the judicial trial in the present.Through continuous optimization and improvement,the artificial intelligence will better serve the transformation strategy of legal governance system and management ability modernization in our country.This paper is divided into four parts in structure.The first part analyzes the necessity of applying artificial intelligence to judicial trials in our country,and discusses in detail the background of the era of the application of artificial intelligence in the judicial trial and the mutual promotion of them.The second part firstly analyzes the application status of artificial intelligence in common law and civil law countries,and then generalizes the specific application forms of artificial intelligence in judicial trials in China,introduces the application of artificial intelligence in representative pilot courts.In the third part,the advantages and disadvantages of the application of artificial intelligence technology in China’s judicial trial are analyzed,affirming the positive role of artificial intelligence in promoting the improvement of judicial trial ability,and at the same time,the deficiencies and deficiencies of the present stage are deeply analyzed.The fourth part,aiming at the problems above,the paper puts forward the reasonable optimization strategy and development suggestions,such as to build a unified smart trial platform,promote the positive interactive between the judges and intelligent judgment system,establish the high quality judicial database,formulate the artificial intelligence algorithm accountability mechanism,etc.This paper discusses how to correctly apply the artificial intelligence technology in the judicial trials,so as to provide references for improving the judicial capacity of Chinese judicial system.
