With the development of the economy,environmental protection has gradually come to the public's vision.The global climate change has become the most important environmental crisis that the whole human society is facing.Its complexity is far beyond the environment crisis that the human society had to deal with in the past.It is not only the problem of ecological environment protection,but also the problem of economic and social development.According to an analysis in the 2011 United Nations Programme Human Development Report,the worsening environmental crisis has the greatest impact on the poor and developing countries.According to data,98 per cent of those killed or affected by natural disasters come from developing countries.By 2025,more than half the population of developing countries could be threatened by floods and storms.At the same time,the threat posed by environmental change is gradually developing into a long-term threat,which will have long-term impacts on some countries and even the whole world.The importance of the right to development has been widely recognized all over the world.From the analysis of the historical evolution of the right to development,the right to development is accompanied by the values of equity and human rights.The right to development and climate change are not only cause and effect but also inevitable contradictions.In order to realize the better development of the whole world and the right to development in a wider scope,it is necessary to explore the relationship between climate change and the right to development.Starting from the specific background of the current global climate change,this paper makes a comprehensive analysis of the current climate change performance,and analyzes the adverse effects of climate change on the world,and then analyzes the impact of climate change on development,the necessity of legal regulation is obtained.Elaborating on the current international development of international legal regulation on climate change,from the Framework Convention on Climate Change to the Kyoto Protocol to the Paris Agreement,the first global climate agreement in history,which entered into force in 2016,analysing the current international legal regulation of climate change and the relationship between the right to development,analysing the causes of the impact of climate change on the right to development,and combining the relevant practices of the domestic and international communities,and on the basis of drawing on relevant experience,at the domestic and international levels,the paper puts forward reasonable suggestions on how to realize the coordination of rational regulation of climate change and the right to development.
