At present, the problem of climate change has been a serious threat to the survival anddevelopment of human. This is the most serious problem of environment that the world hasbeen faced. Climate change is that global warming caused by the increase of thegreenhouse gas which is due to human activity. This has brought profound influence to thedevelopment of humans, animals and plants. Various countries have recognized theseriousness of the problem, have taken active measures to cope with this problem and havediscussed how to control greenhouse gas emotion. The purpose of this paper is that throughthe analysis of the achievements and inadequacies of the international legal documents onthe change of the climate and draw lessons from other countries' legislation experience, wediscuss how to improve our legal system on the climate change.Firstly, this article introduced the specific situation about global climate change.Nowadays the warming rate is so fast.It is mainly composed of human economicactivity.Global warming brings serious effect on the survival of the human, animals andplants. Such as, sea-level rise, crop production reduction, water resource shortage,ecological system changes and extreme weather occurred frequently. To reducegreenhouse gas emission is no time to delay.Secondly, global warming has already caused the international community's attention.In the joint efforts of all countries, the international society began to hold the globalclimate conference to settle the greenhouse gas emission. The conference adopted the"Framework Convention on climate change","Kyoto Protocol", formed the "Bali Islandroad map", the "Copenhagen agreement" and other international legal documents. Theseinternational legal documents played an important role to the reduction of greenhouse gasemissions. They determined the basic principles to cope with the climate change and threekinds of flexible mechanisms about the emission reduction.Developed countries madeclear emission reduction responsibility of different countries and made commitment about provide funding and technology. But there are still inadequacies. It is difficult to reach alegally binding document and emission reduction target is too small.Thirdly, this article analysis the legislations of climate change from different countries.Including the developed countries and regions the United States and European Union,China's neighbor Japan, and the developing country India.They are mainly through thedevelopment of the energy law, renewable energy law, and special energy law to reducegreenhouse gas emissions.Finally, our country does not have the law to deal with climate change. It mainlythough the energy law to reduce the greenhouse gas emission. Legislation system is stillnot perfect.The law is too principle, not suit to operation; the responsibility and obligationis not complete; no timely implementation of international law to domestic law conversion.Our country should draw lessons from the experiences of the international legislations andthe relevant foreign climate policy and legislation. Then we build and improve our law ofclimate change. In the international legal system, our country should assume theresponsibility; enlarge China's influence in the international arena.
