On The Standardized Exercise Of Supervisory Committee's Investigation Power

In accordance with the provisions of the Supervision Law,the newly established supervisory committee has three powers:disposal,investigation and supervision.How to exercise and supervise the investigation power in the practice brought about by the unclear nature of the investigation power of the supervisory committee is also a heated topic in the current theoretical and practical circles.Although the Supervision Law provides for the above contents from the provisions,the author believes that,The power of supervision and investigation needs to be further improved and concrete.Only on the premise of studying the basic connotation of the investigation power,can we put forward some suggestions on standardizing the exercise of the investigation power of the supervisory committee,so as to promote the operation of the supervision and investigation power in accordance with the law,and finally achieve the unity of punishing corruption and protecting human rights.Therefore,the book First of all,starting from the basic connotation of the investigation power,this paper expounds the meaning and attribute of the investigation power of the supervisory committee.Secondly,there are a series of risks of rule of law in the operation of supervision and investigation power,and there are many controls on the personal and property rights of the person under investigation,so there is a perfect space in the implementation of the system,which is necessary to standardize the exercise.Finally,this paper combines the current legal norms and on the basis of the experience of the reform of the supervision system,according to the analysis of the problems existing in the operation of the current investigation power,from perfecting the procedural provisions of the supervision of lien measures.Establish the system of lawyer intervention during the period of supervision and retention,and effectively link up the evidence of supervision and investigation and the card of criminal justice.According to the point of view of strengthening the internal and external supervision of the supervision and investigation power and perfecting the restriction mechanism,this paper puts forward some suggestions for standardizing the exercise of the investigation power of the supervision committee.Furthermore,it ensures that the investigation power is exercised within the track of the rule of law,promotes the supervision organs to exercise the investigation power reasonably and legally,and unifies the rule of law against corruption and the protection of human rights,so that the law can adjust and guide the practical activities more reasonably and effectively.
