Abstract/Summary:
Since the 1770 s,people from China,Japan and other Asian and Pacific coastal countries began to migrate to the United States,gradually developing and growing,forming an Asian American group,but due to economic and ethnic reasons,they were listed as an unpopular group by white Americans.After World War Ⅱ,with the struggle of the post-war democratic movement and the change of American education policy,the rights of Asian American higher education gradually paid attention to and began to have legal protection.The process of guaranteeing the legal rights of Asian American higher education is divided into two parts: First,after World War Ⅱ and before the Civil Rights Movement,in 1947,the California General Assembly abolished the California Education Law and allowed Asian Americans to enter public schools,that is,the abolition of the "isolated but equal" education policy.Second,after the civil rights movement,it further responded to social concerns in the law and paid more attention to the equal protection of the higher education rights of Asian Americans.With the high achievement of Asian Americans in higher education and the low achievement of black Americans and Native Americans,the California House of Representatives passed a new "affirmative act",namely the California ACA-5 Act(Assembly Constitutional Amendment 5).The passage of the bill caused the beginning of the adjustment of higher education preferential policies for Asian Americans,and the protection of higher education rights for Asian Americans was challenged.From the history of Asian Americans,the status of Asian American higher education before World War Ⅱ,by combing the status of the law of the law to guarantee the rights of Asian American higher education,in order to draw lessons from the legislative system of Chinese minority higher education.The full text is divided into four parts.Chapter 1: "Overview of the Legal Protection of Equal Rights for Asian Americans in Higher Education".It mainly discusses the history of Asian American development,the status of Asian American higher education before World War Ⅱ,and the legal basis of the equal rights of Asian American higher education.Chapter 2: "The Main Process of the Legal Protection of the Higher Education Rights of Asian Americans after World War Ⅱ".It mainly discusses the social background and reasons of the legal protection of Asian American higher education rights after World War Ⅱ,the legislation and judicial decision of Asian American higher education rights protection,and the improvement of Asian American higher education rights protection after World War Ⅱ.Chapter III: "Disputes and Evaluation on the Legal Protection of Asian-American Higher Education Rights".It mainly discusses the controversy of the preferential policies of Asian American higher education rights and the legal protection of Asian American higher education rights.Chapter 4: "Thinking and Inspiration".
