| In the great wave of economic globalization,International Labor Standards have attracted more and more attention.Compared with other labor conventions that stipulate technical issues,Core Labor Standards,as the most basic and critical part,have attracted more attention.Therefore,many scholars and experts have explored and studied this.According to the Declaration of Fundamental Principles and Rights at Work,International Core Labour Standards are the basic legislation on the international labour field adopted by the International Labour Organization in the form of International Labour Conventions,including Freedom of Association and Effective Recognition of Collective Bargaining;Elimination of All Forms of Forced Labor;Effective Abolition of Child Labour;Elimination of Employment and Employment Discrimination.It is the responsibility of the international community and respecting the legitimate rights and interests of workers.Therefore,incorporating Core Labor Standards into the domestic implementation of sovereign countries is the need to protect the rights and interests of workers and is the trend of the times.The goal of implementing legislation in the field of labor is to protect labor human rights and realize good laws and good governance.Its also the purpose of the implementation of Core Labor Standards in China,since the establishment of the International Labor Organization,China has made great achievements in promoting the implementation of Core Labor Standards,actively participated in the Labor Organization and other organizations held the meeting of Labor Standards discussion,approved the implementation of the corresponding Core Labor Convention,domestic labor rights and interests to get safeguard,labor order has been maintained.The implementation of Core Labor Standards in China is not only the requirement of China as a member of the International Labor Organization,but also the inevitable choice for China to protect labor rights and interests,respect the human rights of workers and safeguard labor order.Although China has made great achievements in the protection of workers’ rights,it also cannot ignore the growing domestic labor disputes that reflects the considerable difficulties and challenges in the implementation of Core Labor Standards in China.This paper starts from the implementation of Core Labor Standards in China,analyzes the challenges in the implementation of the Core Labor Convention,such as our specific ratified Core Labor Convention is less,and in the labor convention and implementation in the process also has a series of problems,this not only does not conform to the requirements of the implementation of the International Labor Organization convention,also affects the image of labor rights and interests of our country.To explore the reasons behind it,both the labor convention itself supervision and implementation mechanism is not binding enough,that is,the Core Labor Convention as an international law,so it has a "soft law",lack of mandatory binding force,and affected by political color,and the unique domestic environment formed in the process of China’s own development.These two reasons are that the core Labour Convention cannot be fully and effectively implemented.As a lofty and beautiful ideal to comprehensively promote the implementation of Core Labor Standards,it obviously cannot be achieved overnight under the existing international labor law order and domestic labor law order.So to make the Core Labor Standards better implemented in China,Promoting the protection of human rights,It also facilitates the formation of advanced governance experience,Promoting exchanges and mutual reference in the field of labour,China needs to continuously strengthen the implementation of the Core Labor Convention,This requires the joint efforts of all parties,both Labor Organizations need to reform the implementation system of Labor Standards,Improve its supervision and implementation mechanism,Improve and upgrade Labor Standards.To promote its greater justice and rationalization,China also needs to help explore the implementation of Core Labor Standards,Improve various systems and actively integrate them into the ILO.In addition,China can use the power of Labor Organizations and combine its own development characteristics to promote the full implementation of Core Labor Standards. |
