| This article mainly focuses on China’s part-time employment system as the research theme.With the continuous economic development,part-time employment forms are gradually being favored by many employers.However,China’s current part-time employment system still has shortcomings.The law emphasizes too much flexibility and lacks safety for part-time workers.This article combines cases to analyze the problems in my Chi’s part-time employment practice,further sorts out the current situation of the part-time employment system,and reflects on the shortcomings.,and reflects on the shortcomings,such as the lack of formality in contract formation,the lack of labor remuneration standards,and the incomplete payment system,Dissolution or termination of labor relations without justification,etc.At the same time,introduce the mature part-time employment system of foreign countries,mainly in Germany,Japan,and UK,after compared,we can learn from them in the mature parts,so we can bring equal-treatment principle into part-time employment system into ours,correct the deviation legislative value orientation.With this principle,we shall improve the safety of the part-time employment system of China.The dissertation includes five parts:The first part introduced the background of China’s part-time employment system,further combing the status quo of China’s part-time employment legislation and academic research,and the article’s writing ideas and adoption research Method;The second part is to explain the concept and value of part-time employment,and analyze the problems in practice based on cases;The third part is to introduce the current status of the development of part-time employment legislation,and further sort out part-time employment in China The status quo of the system reflects on the inadequacies in terms of labor contracts,labor standards,labor termination and termination,and labor disputes;The fourth part is an introduction to part-time employment systems in foreign countries,and then analyze the corresponding shortcomings through the methods of comparison between China and foreign countries,and learn from the useful experience;The fifth part is based on the previous elaboration and analysis,from the legal level,puts forward corresponding suggestions for improvement,and establishes a reasonable legislative value orientation,and at the same time draws on the legislative model of labor dispatch,and makes special legislation for part-time employment in China. |
