In recent years,there have been frequent "overwork deaths" incidents,and people’s attention to this issue has been increasing.Due to the high pursuit of work efficiency,"overwork" is no longer the only occurrence in the IT industry,but shows a phenomenon of rapid proliferation in various industries.Behind the "overwork death" involves the interests of each individual,as well as the stability and harmony of society.How to use legal means to protect the legitimate rights and interests of workers and prevent society from entering the "overwork death" mode is a question worth discussing.The article aims to analyze the concept of "overwork death" and the current problems of China’s "overwork death" legal regulation,based on the national conditions,combined with overseas experience on how to improve China’s "overwork death" legal regulation Put forward relevant legislative proposals.In addition to the introduction and conclusion,the article is mainly divided into the following four parts;Part I: A general analysis of "overwork".Introduce the concept and development status of "overwork".Through the analysis of its concept,characteristics,components and the current situation and causes of China’s "overwork death" phenomenon,the importance of improving relevant laws and regulations is revealed.The second part: Based on the current domestic legislation on "overwork death",through the analysis of the "Constitution","Labor Law","Work Injury Insurance Regulations",etc.,to explore the inadequacy of China’s legal regulations on "overwork death".The third part: draw on the legal regulations on the issue of "overwork death" outside the region,through comparative research on the legal regulation experience of "overwork death" in Japan,Germany,and Chinese Taiwan,and draw on the strengths and weaknesses to formulate "overwork death" Laws and regulations provide inspiration.Part IV: Combining practice,put forward suggestions to improve China’s "overwork death" legislation.Through the foregoing analysis and research,the article concludes that the legislation-first model is most suitable for China’s development.By perfecting legislation and incorporating "overwork death" into the category of work injury identification and legal relief,building a supporting social security mechanism can effectively curb the development of "overwork death" and prevent China from entering the "overwork death" mode.
