Research On The Legal Issues Of "death From Overwork" Work Injury Recognition

With the rapid development of our country's economy and society,the social competition is becoming more and more fierce,and the supply of labourers force exceeds the demand.Speeding up the pace of work and life of labourers has led to serious overwork in the work of workers in our country.Overwork poses a serious threat to the life and health of labourers,and enterprises adopt various assessment systems,which lead to labourers' voluntary overtime work and skillfully evade the obligations conferred by the law on enterprises.In recent years,the phenomenon of karoshi occurred frequently in our country and showed the trend of youth.However,there is still a lack of legislation on karoshi in China,which also makes the legitimate rights and interests of workers unable to be effectively protected.In the face of the more and more serious situation of karoshi,there is no unified conclusion between theoretical and practical circles.Therefore,the research on the legal problem of karoshi have great practical significance.First of all,by summarizing the theory of karoshi and the analysis of domestic viewpoints,this study leads to the rationality and necessity of industrial injury determination of karoshi.Secondly,the study introduces the dilemma and existing problems of the industrial injury identification of karoshi in theory,and through the introduction and analysis of the overseas advanced experience in the determination of karoshi injury,seeks the enlightenment to the industrial injury identification of karoshi in our country.Finally,from the aspects of the perfection of the existing industrial injury insurance system,the identification standard and the cognizant institution,some suggestions are put forward to perfect the industrial injury identification system of karoshi in China.
