Research On The Government Information Disclosure In Emergency

Emergencies refer to natural disasters,accidents,public health events and social security events that occur suddenly and cause or may cause serious social hazards and need to be dealt with by emergency response measures.They are characterized by sudden and serious social hazards and urgency of handling.After the occurrence of an emergency,the information about an emergency has attracted extensive attention from all walks of life in terms of its cause,scope,influence and development trend.Therefore,the government,as the performer of public power,should ensure the timely,accurate and comprehensive disclosure of government information in response to emergencies to protect citizens’ right to know and right to supervise,establish a good government image and maintain a good social order.Although the construction of government information disclosure system in China’s emergency response has made great progress,there are still some problems in theory and practice.From the legislative point of view,the existing legal system of government information disclosure for emergencies should be further standardized,and there are problems such as low level of legal effect and scattered and general legislation.From the perspective of subject,scope and published content,there are still some problems,such as unclear subject,incomplete scope,infringement of citizens’ privacy right and untimely release of some disclosed content.At the same time,in the construction of relevant systems,there are problems such as improper handling of online public opinions and inadequate understanding of new media in the information release,and deficiencies such as imperfect supervision means and loopholes in the accountability system.Based on this,we should rely on the world experience,based on the actual development of China,combined with the past major emergencies,at the legislative level,legislation to improve the government information disclosure system in emergency response;From the main body and procedure point of view to set up special standing institutions to realize the relative centralization of decision-making power and standardize legal procedures;From the relevant institutional mechanisms and improve the dynamic real-time release mechanism,set up double track information release mechanism and perfect the information disclosure channels to ensure the information timely,comprehensive control for the network public opinion at the same time,deal with Internet rumors,and media cooperation in shaping public opinion actively,and regulate the responsibility mechanism,clear responsibility object,strengthening responsibility.
