| In China,the stages of education are divided into compulsory and noncompulsory stages,of which the compulsory stage is the time limit for citizens to fulfill their obligation to receive education.In the compulsory education stage,citizens’ right to education and their obligation to receive education have a unified and complex relationship,and under the dichotomy of "individual-state",it is clear that the fulfillment of the obligation to receive education is conducive to the organic unity of citizens’ personal development with national construction and social progress.On this basis,it is clear that the subjects of the duty to educate should be broadly defined to include citizens,families,the State,schools and social organizations.Subject to the capacity of citizens of school age,citizens and families together constitute the subjects of the obligation to receive education,and have the compulsory and social obligation to receive compulsory education.As the right to education in the compulsory education stage has the function of the right to benefit and the objective value of order,the state is the subject of guaranteeing the fulfillment of the citizens’ obligation to receive education and assumes the corresponding obligation to pay and protect.Schools and social organizations,as important auxiliary subjects for citizens to receive compulsory education,assume important auxiliary obligations.The case of the Yunnan government against the school dropout is essentially an example of the government’s duty to protect and pay for the failure of citizens and families to fulfill their obligation to receive education effectively.At the current stage of compulsory education,there is still a blurring of the subject,nature and responsibility of the obligation to receive education,and there is therefore an urgent need to ensure that citizens receive compulsory education by improving the mechanisms for safeguarding the fulfillment of their obligation to receive education.Specifically,it is important to establish and improve the mechanisms of protection and payment by the State,fulfillment by citizens and families,and support by schools and social organizations,in order to ensure that citizens of school age receive compulsory education and promote individual development and social progress,with the main focus on the subject of the obligation to receive education and the boundaries of the nature and responsibilities of the obligation. |
