Research On International Law In International Disaster Relief

The development of human society is accompanied by disasters.In particular,the severity of many disasters is beyond the capacity of the affected countries,which requires the assistance of the international community.International disaster relief has become the most important way for the international community to rescue all kinds of disasters.However,so far,the rules of international law regulating international disaster relief are scattered in various treaties,resolutions and other non legally binding directives and rules.In particular,the covid-19 outbreak of the new crown pneumonia in 2020 is a global pandemic.The global public health assistance has made the international community more concerned about international disaster relief,which has made new challenges to international disaster relief in the past.This paper mainly studies from the following aspects.The first part is to sort out the existing international laws related to international disaster relief and define the concept of international disaster relief.It mainly summarizes the main contents of international disaster relief through the induction of existing international legal documents and the current practice of international disaster relief,and obtains the concept and characteristics of international disaster relief through the understanding and research of the first two parts.The second part studies the problems existing in the current practice of international disaster relief,such as the fragmentation of existing international laws related to international disaster relief,the complexity of international disaster relief,mainly including equity,the nature of international disaster relief obligations,and finally the conflict of laws of treaties related to international disaster relief.The third part is the countermeasures proposed after in-depth thinking on the problems mentioned and studied in the previous article,mainly including formulating a universal treaty specifically for international disaster relief,clarifying the main responsibilities and obligations in international disaster relief,improving the current problem of fair distribution in international disaster relief,and constructing a relatively effective supervision mechanism of international disaster relief.The fourth part mainly combs the international treaties related to international disaster relief and the impact of the development of international law rules related to international disaster relief on China.At the same time,it also summarizes the practice of international disaster relief participated by China in recent years.
