| With the continuous improvement of China’s economic strength and the continuous improvement of China’s comprehensive national strength,the United States,which is determined to dominate the world and establish a unipolar world,must contain and suppress China’s rise.At a time when the U.S.takes China as its main competitor,unilaterally withdraws from the Iran nuclear deal and uses secondary sanctions to suppress China,and the U.S.-led Western countries use the Russia-Ukraine conflict as an excuse to impose the most severe sanctions in history on Russia,the analysis of The historical dilemma of legal regulation of secondary sanctions and the preparation for their sanctions are particularly important.At the legal level,the United States mainly protects the application of its secondary sanctions through the principle of territorial jurisdiction and the principle of effect of the principle of national jurisdiction,UN Security Council resolutions,and security exceptions.Regulatory Dilemma.Analysis of the reasons for the predicament of secondary sanctions regulation can be found: firstly,it is manifested in the rapid development of economic globalization,and the expansion trend of extraterritorial application of laws between countries is obvious,and secondary sanctions are a microcosm of the process.Secondly,the monitoring mechanism of the sanctions of the Security Council resolutions fails to supervise the secondary sanctions,while the theoretical doctrines and normative guidelines related to the international law have developed slowly and have many disputes.The final secondary sanctions rely on the strong national strength of the United States,and many major powers in the world are allies of the United States,so they tolerate and make concessions to them,causing the dilemma of their regulation.There are many pioneers in dealing with U.S.secondary sanctions.As the U.S.checks and balances the world,the scope of sanctions is too broad.Therefore,there are not only Western countries such as the European Union and Canada,but also old-fashioned hostile forces in the United States such as Russia and Iran that have responded to their secondary sanctions.The EU and Canada have no effective way to respond to the secondary sanctions of the United States at the international level.Both of them have blocked the effect of secondary sanctions in the country by blocking legislation,hoping to reduce the damage to domestic market players.Russia and Iran,relying on their natural advantages in energy resource endowments,combined with internal affairs measures and diplomatic strategies,have stubbornly resisted the US economic sanctions and blockades.By analyzing and judging the measures taken by Western countries,Russia and Iran to deal with the secondary sanctions of the United States,we try to summarize their experience and make suggestions for China’s response: at the international level,we should not only use multilateral platforms,but also promote the rapid development of the process of RMB nationalization.At the domestic level,it is necessary to improve and perfect the existing "Blocking Legislation",and at the same time supervise and strengthen the risk resistance ability of enterprises to deal with sanctions. |
